USE OF THE NAME. WESTWOOD" OR "WHG". The Adviser has the right to use the names "Westwood" and/or "WHG" in connection with its services to the Trust and that, subject to the terms set forth in Section 8 of this Agreement, the Trust shall have the right to use the name "Westwood" and/or "WHG" in connection with the management and operation of the Funds. The Adviser is not aware of any threatened or existing actions, claims, litigation or proceedings that would adversely effect or prejudice the rights of the Adviser or the Trust to use the name "Westwood" and/or "WHG."

USE OF THE NAME. CALIFORNIA INVESTMENT TRUST". CCM Partners, a California Limited Partnership, ("Management") has consented to the use by the Trust of the identifying words or name "California Investment Trust" as the name of the Trust. Such consent is conditioned upon the employment of Management, its successors or any affiliate thereof, as Manager of the Trust and its Series.
