Abnormal Conditions Sample Clauses
The Abnormal Conditions clause defines how parties should respond when unforeseen or extraordinary circumstances disrupt normal contract performance. Typically, this clause outlines procedures for notifying the other party, adjusting timelines, or suspending obligations if events such as natural disasters, strikes, or other unexpected incidents occur. Its core function is to allocate risk and provide a clear framework for managing disruptions, ensuring that neither party is unfairly penalized for delays or failures caused by events beyond their control.

Abnormal Conditions. Employees working under abnormal conditions involving such things as gas, extreme heat, excessive dirt, prefab or installation of fibreglass, and similar physical circumstances which make the work unusually exhausting, distasteful or hazardous, shall be paid five percent (5%) above the hourly rate of pay. The question of whether or not the conditions are abnormal shall be subject to the available grievance and arbitration procedures.
Abnormal Conditions. If abnormal operating conditions that prevent the recordation of any required parameter occur during a SCT (including a level of irradiance that does not permit the Generating Facility to produce sufficient Charging Energy), Seller may postpone or reschedule all or part of such SCT in accordance with Part II.F below.
Abnormal Conditions. If abnormal operating conditions that prevent the recordation of any required parameter occur during a SCT, Seller may postpone or reschedule all or part of such SCT in accordance with Part II.F below.
Abnormal Conditions. To the extent any Party is aware of any Abnormal Condition, such Party, subject to the satisfaction of and compliance with Regulatory Requirements, will make Reasonable Efforts to promptly notify the other Parties of such Abnormal Condition if it may reasonably be expected to affect a Party’s operation of its transmission system. However, the failure of any Party to provide notice in conformance with this Section 7.4 shall not constitute a material breach of this Agreement.
Abnormal Conditions. 30.01 The parties have agreed, effective October 27, 1986, to a one-time "buy-out" of Article 29 "Height Pay & Hazardous Pay" and Article 30 “Abnormal Conditions” in exchange for a total of One Dollar ($1.00) per hour. HISTORICAL NOTE: Effective October 27, 1986, the "Total of One Dollar ($1.00)" shown above in Article 29 "Height Pay & Hazardous Pay" and Article 30 "Abnormal Conditions" has, at the request of the Union, been included in Section "D", Article 38, "Welfare, Industry Improvement & Association Funds", and it is further agreed and understood by the parties that the aforementioned "Total of One Dollar ($1.00)” is NOT subject to increase by the application of the overtime provision.
Abnormal Conditions. The re-routing of traffic under abnormal conditions will be according to the alternate routing indicated in the routing tables supplied by Telkom as for 2.2 above. It is agreed to inform the other Party of such re-routing undertaken in the event ofseverance of routes. When only a portion of a route has failed, traffic should continueto be offered to the remaining portion of that route before overflowing to latter choiceroutes. In the event of the available capacity on the designated alternative routesbeing insufficient to handle all the overflow traffic, then each/either Operator mustcontact the other to seek agreement to route the remainder of the traffic through its own network to an alternative POI. The predefined prescribed arrangements anddetails of the information to be handed over in such an event, will be encompassed in 4.a document to be drawn up by the appropriate sub-committee. In the event that thepredefined routing arrangements for abnormal conditions cannot be implemented dueto exceptional circumstances within the PSTN, Telkom will provide details of thealternative arrangements which are to be implemented in their place.2.4 Route Diversity and Security ArrangementsFor reliability signalling links must be provisioned over physically diverse transmissionpaths and/or equipment where such exists. Any deviation from this rule must benegotiated and agreed to in writing between Telkom and Vodacom.Telkom undertakes that the following rules will apply with respect to service levels. These will be assessed over any Accounting Period:1. At a service level of 99. 5% there will not be a need for diversity in any form.2. At a service level of 99. 9% Telkom shall provide transmission equipment diversity but not necessarily route diversity.3. For the 99. 95% service level then Telkom shall provide transmissionequipment and route diversity. The above rules would not incur extra costs to Vodacom and any chance to themmust be discussed between the Parties. All 2 MBit/s systems carrying CCS 7 signalling links between MSCs and/or the POlsshall be clearly marked in the switching and transmission equipment rooms so as toprevent any unnecessary maintenance activities. The minimum number of links per link set shall be two. Any number of links per linkset, however, exceeding 2 shall be negotiated between Vodacom and Telkom. Allcircuit conditioning equipment such as PADS and echo cancellers must be removedfrom the signalling links.accordance with CCITT Recommendations E. 1...
Abnormal Conditions. If abnormal operating conditions occur during a Test, SCE may postpone or reschedule all or part of such Test in its reasonable discretion in accordance with PART II.F. or PART II.G., below.
Abnormal Conditions. If the supported algorithms for encryption defined in the UE Security Capabilities IE in the UE Context Information IE, plus the mandated support of the EEA0 and NEA0 algorithms in all UEs (TS 33.501 [28]), do not match any allowed algorithms defined in the configured list of allowed encryption algorithms in the NG-RAN node (TS 33.501 [28]), the NG-RAN node shall reject the procedure using the HANDOVER PREPARATION FAILURE message. If the supported algorithms for integrity defined in the UE Security Capabilities IE in the UE Context Information IE, plus the mandated support of the EIA0 and NIA0 algorithms in all UEs (TS 33.501 [28]), do not match any allowed algorithms defined in the configured list of allowed integrity protection algorithms in the NG-RAN node (TS 33.501 [28]), the NG-RAN node shall reject the procedure using the HANDOVER PREPARATION FAILURE message. If the CHO trigger IE is set to "CHO-replace" in the HANDOVER REQUEST message, but there is no CHO prepared for the included Target NG-RAN node UE XnAP ID, or the candidate cell in the Target Cell ID IE was not prepared using the same UE-associated signaling connection, the NG-RAN node shall reject the procedure using the HANDOVER PREPARATION FAILURE message. If the HANDOVER REQUEST message includes information for a PLMN not serving the UE in the target NG-RAN node in the Management Based MDT PLMN List IE, the target NG-RAN node shall ignore information for that PLMN within the Management Based MDT PLMN List. If both the PNI-NPN Area Scope of MDT IE and the Area Scope of MDT-NR IE are included in the MDT Configuration-NR IE in the HANDOVER REQUEST message, and the Area Scope of MDT-NR IE is set to "PNI-NPN based", the target NG-RAN node shall, if supported, use the Area Scope of MDT-NR IE to derive the MDT area scope for MDT measurement collections in PNI-NPN areas, and ignore the PNI-NPN Area Scope of MDT IE. If the PNI-NPN Area Scope of MDT IE is included in the MDT Configuration-NR IE in the HANDOVER REQUEST message, and the Area Scope of MDT-NR IE is not included, the target NG-RAN node shall ignore the PNI-NPN Area Scope of MDT IE, and consider that the MDT Configuration for NR is applied to all PLMNs indicated in the MDT PLMN List described in TS 32.422 [23].
Abnormal Conditions. Periodically (once every two weeks) observe trees and shrubs for abnormal conditions such as insects, borers, web worms, red spiders, etc., and immediately treat.
Abnormal Conditions. Employees working under abnormal conditions involving such things as gas, extreme heat, excessive dirt and similar physical circumstances which make the work extremely exhausting or distasteful shall be paid a premium of 25% of the hourly rate of pay. The question of whether or not the conditions are abnormal shall be subject to Article 11D.02 below and/or regulations laid down by the Department of Labour of Nova Scotia.
