Acceptable Use of the Services. The Client and its Users may not:
(a) use, or encourage, promote, facilitate or instruct others to use the Services for any illegal, harmful, threatening, abusive, harassing, tortious, indecent, obscene, libelous, menacing, offensive or invasive of another person’s privacy use or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, threatening, abusive, harassing, tortious, indecent, obscene, libelous, menacing, offensive or invasive of another person’s privacy;
(b) use the Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device;
(c) interfere with or disrupt the Services or servers or networks connected to the Services or disobey any requirements, procedures, policies or regulations of networks connected to the Services or misuse the Software by introducing viruses, defects, trojans, worms, logic bombs or other material or item which is technologically harmful or destructive in nature;
(d) attempt to gain unauthorized access to the Software, the server on which the Software is stored, or any server, computer or database connected to the Cloud Provider;
(e) attack the Software via a denial-of-service attack or a distributed or malicious denial-of service attack;
(f) remove any legal, copyright, trademark or other proprietary rights notices contained in or on materials the Client receives or accesses pursuant to this Agreement;
(g) make network connections to any users, hosts, or networks unless the Client has permission to communicate with them;
(h) distribute, publish, send or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising or solicitations (like ‘spam’), including commercial advertising and informational announcements; and/or
(i) use the Services in any way so as to bring the Services, or any part thereof or any third-party related thereto, or the Provider into disrepute. The Provider reserves the right, but does not assume the obligation, to investigate any violation of this Section or misuse of the Services.
Acceptable Use of the Services. Company agrees that it will not (a) modify, copy, decompile, disassemble or reverse engineer, or cause any other party to modify, copy, decompile, disassemble or reverse engineer, ECHEZ’s Intellectual Property; (b) sublicense any of ECHEZ’s Intellectual Property to third parties or sell, resell, rent, sublicense or lease the Services to third parties; (c) otherwise violate the license grant or restrictions set forth in Section 8 above; (d) use the Services for malicious or unauthorized purposes; (e) interfere with or disrupt the integrity or performance of the Services, ECHEZ operations, or third-party data contained therein either directly or using third party technology ; (g) alter, copy, move or delete any tags or code placed as part of the Services; (h) use or permit, enable or assist any third party to use, the Services to create competing products or services.
Acceptable Use of the Services. You acknowledge that the Services enable you to communicate with other users of our Services and post comments and briefings, messages, investment ideas, personal information, images, text and other material (“User Content”) which can be seen by others, for example, in Invstr feeds, league tables, profiles, public or private chat groups or anywhere else in the App, Website or Invstr Software. You agree that in using the App, Website and the Invstr Software, you will:
1. not post or otherwise make available any User Content which is unlawful, defamatory, obscene, offensive, racist, illegal, incites hatred or criminal activity, has the effect of being harassing, threatening or abusive to any individual or group of individuals (including on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability or otherwise) or which infringes any third party’s rights;
2. not spread rumors in relation to any investments, markets or any other financial information;
3. not create false impressions in relation to any investments, markets or any other financial information;
4. not manipulate the financial markets in any way in your use of the Services;
5. not discriminate against other users of the Services;
6. not provide investment advice or hold yourself out as providing investment advice;
7. not create spam messages;
8. not distribute viruses or any other technologies that may harm Us or the interests of any other users of the Services, or otherwise interfere with or disrupt our systems;
9. not do anything to bring Us or the Services into disrepute;
10. not solicit or attempt to solicit personal information from any other user;
11. not impersonate any other person, including falsely representing a company 12. not advertise other products or services; and
Acceptable Use of the Services. The Client must use the Services in accordance with this Agreement and in accordance with all applicable laws. The Client must not attempt to breach or circumvent Platform security. In addition, the Client must not use the Services in any fashion that would, or assist others to: mislead or deceive; post or transmit information that infringes or violates the rights of a third party, including the rights of privacy and publicity; cause or knowingly facilitate the spread of a virus, worm, Trojan horse, or another harmful object; post or transmit unsolicited messages, junk mail, spam or chain letters or material that might be considered offensive; collect or store personal data without permission; promote in any way illegal or unwelcome or unsociable activities; attempt to breach or circumvent Platform security; assist BidContender competitors; or undertake promotions or undertake commercial activity not connected with the business purposes the Services are intended to support. In order to provide the Services effectively and in accordance with applicable law and this Agreement, BidContender may monitor and record the Client’s use of the Services and the Client authorizes BidContender to collect, store and use all such information provided BidContender complies with Section 6.
Acceptable Use of the Services. (a) You agree that you will use the Services in accordance with the terms of this Agreement. The following uses of the Services are prohibited:
(i) Transmitting any material that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations;
(ii) Harming, or attempting to harm, minors in any way;
(iii) Transmitting any material that threatens or encourages bodily harm or destruction of property or harasses another;
(iv) Disseminating or posting harmful content including, without limitation, viruses, Trojan horses, worms, time bombs, zombies, cancelbots, or any other computer programming routines that may damage, interfere with, secretly intercept or seize any system, program, data or personal information;
(v) Making fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as “pyramid schemes,” “Ponzi schemes,” and “chain letters”;
(vi) Forging of any TCP-IP packet header, email header or any part of a message header (this prohibition does not include the use of aliases or anonymous remailers);
(vii) Transmitting any unsolicited commercial email or unsolicited bulk email or engaging in activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email, whether or not that email is commercial;
(viii) engaging in auto-dialing, continuous or extensive call forwarding, telemarketing, fax broadcasting or fax blasting;
(ix) Accessing, or attempting to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of BTC’s or another entity's computer software or hardware, electronic communications system or telecommunications system, whether or not the intrusion results in the corruption or loss of data;
(x) Infringement of intellectual property rights or other proprietary rights, including, without limitation, material protected by copyright, trademark, patent, trade secret, or any other proprietary rights of any third-party;
(xi) Collecting, or attempting to collect, personal information about third- parties without their knowledge or consent;
(xii) Reselling the Services without BTC’s prior written authorization; provided, in the event BTC authorizes reselling of any or all of the Services, you agree that you bear the sole responsibility for 1) providing any such Services to any third-party, 2) any dispute, claim, or controversy arising out of or relating to providing such Serv...
Acceptable Use of the Services. Your permission to use the Services is contingent on your compliance with all Applicable Law, in addition to the following rules:
Acceptable Use of the Services. Neither you nor your End-Users may use the Services for any purpose identified in the Acceptable Use Policy, which is incorporated herein by reference as if fully stated herein. We reserve the right to immediately terminate your Services, or those of your End-Users if, in our sole and absolute discretion, we determine that your or such End-Users have used the Service or the Device for an unlawful or restricted purpose. If we believe that you or your End-Users have used the Service for an unlawful purpose, we may forward the relevant communication and other information, including your identity or that of your End-User, to the appropriate authorities for investigation and prosecution. You hereby consent to our forwarding of any such communications and information to these authorities. In addition, Varconnect will provide information in response to law enforcement requests, subpoenas, court orders, to protect it’s rights and property and in the case where failure to disclose the information may lead to imminent harm to the customer or others.
Acceptable Use of the Services. You agree that you will not use the Services to do any of the following or take action that results in any of the following: ● Making defamatory statements regarding Users, other persons, or entities, or using the Services in a commercially unreasonable manner or in any manner that would harm or disparage Summit Learning or the Services; ● Doing anything or posting information that is abusive, harmful, threatening, harassing, defamatory, bullying, stalking, or otherwise objectionable; ● Doing anything unlawful, deceptive, misleading, illegal, unethical, malicious, or discriminatory, obscene, hateful, or sexually-explicit; ● Degrading others on the basis of gender, race, class, ethnicity, national origin, religion, sexual preference, orientation or identity, disability, or other classification or otherwise posting or approving content that: is hate speech, discriminating, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence; ● Violating a person’s right to privacy or publicity or otherwise collecting, using, or disclosing data, including personal information, about other Users without consent or for unlawful purposes in violation of any applicable international, federal, state or local law, statute, ordinance or regulation (“Law”); ● Infringing on, misappropriating or otherwise violating the copyright, trademark, patent or other intellectual property rights of any person, including rights in content available through the Services without prior written permission of Summit Learning or the User, as applicable; ● Collecting, soliciting, or otherwise obtaining login information or accessing an account belonging to someone else; ● Accessing (or attempting to access) any service on the Services by any means other than as permitted in this Agreement or operating the Services on any computers or accounts on which you do not have permission to operate; ● Violating any applicable Law, or advocating illegal activity; ● Using the Services in any manner that is harmful to minors. Without limiting the foregoing, you will not transmit or post any content anywhere on the Service, including any User Submission, that violate child pornography laws or that otherwise violates any child sexual exploitation laws. Acceptable Use of the Services. You must not misuse or abuse the Services and shall not engage in any of the following activities:
i. Compromising the integrity of the Services, including probing, scanning, or testing the vulnerability of the Services or network unless otherwise authorized by HP to perform such activities.
ii. Using the Services for any different purpose than it was intended for in its corresponding usage parameters or documentation.
Acceptable Use of the Services. Subject to the restrictions defined in these Terms, ITaLAM grants you a limited, non-exclusive, non- transferable, non-sub licensable, revocable license to use the Services, solely for your personal use. The following terms define the acceptable use of the Services and the content available therein. You agree to abide by all applicable laws. You further agree that you are solely responsible for all acts or omissions associated with your access and use of the Services and the access and use of the Services by anyone on your behalf. While using the Services, you will refrain from – Breaching these Terms or any other applicable Services rules and instructions that we may provide; Interfering with, burdening or disrupting the functionality of the Services; Breaching the security of the Services or identifying any security vulnerabilities in it; Circumventing or manipulating the operation, or functionality of the Services, or attempting to enable features or functionalities that are otherwise disabled, inaccessible or undocumented in the Services; Using or launching any automated system, including without limitation robots, crawlers and similar applications to collect and compile content from the Services; Displaying the Services or any part thereof in an exposed or concealed frame, or linking to elements or portions of the Services, independently from the web pages on which they originally appear; Displaying content from the Services, including by any software, feature, gadget or communication protocol, which may alter the content or its design; Impersonating any person or entity, or making any false statement pertaining to your identity, employment, agency or affiliation with any person or entity; Collecting, harvesting, obtaining or processing personal information of or about other users of our Services; and Linking to the Services from web pages that contain pornographic content or content that is unlawful or encourages prohibited activity such as racism or wrongful discrimination.
