Access and Use of the Services. 2.1 The Bank has agreed to provide the Customer use of the Services and access to mashreqMATRIX in accordance with the terms and conditions of this Agreement, the Bank’s internal policies and in accordance with the Law. 2.2 The Services provided by the Bank under this Agreement shall consist of: a) Financial Services: services which include Instructions given via mashreqMATRIX or changes advised which, if accepted by the Bank, have or may have an impact on the operation and/or balances of the Accounts; and/or b) Non-Financial Services: services which include making enquiries, initiating requests to download statements and other activities not covered by Financial Services. 2.3 Access to and continued use of the Services shall be granted: (a) only through the Bank’s website, (b) shall be permitted after completion of the Services Level Start-Up Form, (c) to each Account of the Customer that is specified in the Service Level Start-Up Form and/or in the Account Addition Form, and (d) upon compliance, to the satisfaction of the Bank, of all security procedures by the Customer and the Users as may be specified by the Bank from time to time. 2.4 Service Level Start-Up Form: 2.4.1 The Customer is required to complete and submit the Service Level Start-Up Form simultaneously with the execution of this Agreement specifying the service level requirements of the Customer with respect to the Service. 2.4.2 The Customer hereby authorises the Bank to set up mashreqMATRIX for it relying on the information specified in the Service Start-Up Form submitted to the Bank. 2.4.3 Each time there is a change with respect to any information specified in the Service Level Start-Up Form or in any service level requirement of the Customer, the Customer shall, immediately, submit a new Service Level Start-Up Form duly completed and executed specifying the new service level requirements or the new information of the Customer. Access and Use of the Services. Subject to the terms and limitations of this Agreement, Reachify agrees to provide Subscriber access to the Services and Equipment as set forth on Service Order(s), up to the quantities specified on such Service Order(s), during the Contract Period and any renewals thereof, on a non-exclusive, non-transferable basis, solely for Subscriber’s internal business purposes and as may be requested or necessary between Subscriber and its customers. Access and Use of the Services. 2.1. Provision of the Services. Company will make the Services available to Customer pursuant to the terms of the Agreement and the Documentation. Company will use commercially reasonable efforts to make the Services available 24x7. Customer acknowledges that Customer's use of the Services requires access to third-party hardware, software, internet and/or telecommunications access, and that Customer's ability to access and use the Services may be affected by Customer's choices and the performance of those products and services. Customer is responsible for all fees and charges imposed by such third parties.

C. CSP will employ the use of third party services for the purpose of facilitating Services use. By submitting User’s information, User grants CSP the right to provide the information to these third parties subject to CSP’s Privacy Policy. CSP reserves the right to refuse or cancel User’s access to the Services at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in User’s order, error in User’s information, or other reasons. Access and Use of the Services. Subject to Customer's compliance with the terms of this Agreement including timely payment of all fees, Customer may during the Term and solely in connection with Customer’s distribution of Customer Content to End Users as part of the Customer services, in the Territory: (a) access and use the Services solely through the Services APIs, (b) use the Services with Supported Devices and Customer Application(s), and (c) use the Documentation delivered by NAGRA in connection with the Services, as set out in this Agreement. Customer may not sublicense, resell, transfer these rights or use them for the benefit of a third party. As a User, you must make the final determination as to the value and appropriateness of contributing to any User, Campaign, or Event. (3) ZA Care does not Solicit: ZA Care offers a Platform for Campaign Organizers to raise money. We merely provide the technology to allow Campaign Organizers to connect with Donors. The existence of the Services is not a solicitation of donations by ZA Care, and ZA Care does not engage in any solicitation activities or consult on the solicitation of contributions from the public, on behalf of any individual, entity, or organization. By using the Services, you understand and agree that ZA Care shall not be responsible for the use of your donations or the amount of funds raised for the Campaign Organizers, Users or Events.
