Common use of Access Road Clause in Contracts

Access Road. (a) The access road will be constructed by NCC as per attached layout plan to connect the Demised Premises with the nearest public road and allow using it by the Company. In addition to that The Company shall take additional works related to expansion and strengthening of the access road if required at its own cost and responsibility.. Upon completion of the Access Road, the NCC shall hand over the completed Access Road to Company and risk and responsibility for the Access Road shall pass to Company from the time of the hand over. (b) NCC hereby grants to the Company the right to the non-exclusive, free and unfettered use of the Access Road Corridor (following the hand over of the completed Access Road by the NCC to Company pursuant to Sections 3.4(a) and (b)) the Access Road, throughout the Term. (c) Company shall throughout the Term maintain clear, unencumbered title (free of all mortgages and Liens) to the Access Road. (d) Following the hand over of the completed Access Road by the NCC to Company pursuant to Sections 3.4(a), Company shall at its own cost throughout the Term maintain the Access Road each to a standard sufficient for the purposes for which the Company intends to use it and in accordance with the terms of this Land Use Agreement.
