ACCESS TO ELIGIBLE SERVICES. The following terms are in addition to the terms of the Remarketer Terms Attachment for Services:
ACCESS TO ELIGIBLE SERVICES. We will provide to you User Identifications which enable access to Eligible Services. You may authorize the Customer to access an Eligible Service by providing a User Identification to that Customer. The Customer may in turn provide User Identifications to its End Users of the Eligible Services. You are responsible for the control and distribution of User Identifications to Customers. You will require your Customers to be responsible for the control and distribution of User Identifications to End Users. We have no responsibility for misuse of User Identifications not under our control. You agree to notify us in writing of a new authorized Customer and of the User Identifications assigned to that Customer. You also agree to provide us with all information we reasonably require to enable your Customers and their End Users to access an Eligible Service (or to terminate such access). We may withdraw access to an Eligible Service from you when, in our opinion, you, your Customers, or their End Users cause any part of an Eligible Service to malfunction. We may withdraw access if there is a failure to make changes which, in our judgment, are necessary to correct malfunctions. We will promptly notify you if we withdraw access to an Eligible Service pursuant to this paragraph. You may acquire Eligible Services for your own internal use under the terms, including prices, of the applicable Transaction Documents and any other terms to which we mutually agree.

  • Available Services Subject to the terms of this agreement, Manager may obtain any of the Available Services from Sprint Spectrum in accordance with the provisions of this Section 2.1. The Available Services offered from time to time and the fees charged for such Available Services will be set forth on the then-current Exhibit 2.1.1 (the "Available Services and Fees Schedule"). If Sprint Spectrum offers any new Available Service, it will deliver a new Exhibit 2. 1.1 indicating the new service and the fee for the new service. Manager may select one or more of the categories of Available Services. If Manager selects a particular category of services it must take and pay for all of the services under the category selected; Manager may not select only particular services within that category. If Sprint Spectrum determines to no longer offer an Available Service and the service is not a Selected Service, then Sprint Spectrum may give Manager written notice at any time during the term of this agreement that Sprint Spectrum no longer offers the Available Service. 1.1 will be deemed amended upon delivery of the new Exhibit 2.1.1

  • Access to Services Subject to and in accordance with the terms of this Agreement, including any Schedules, Company grants You a non-exclusive, non-sublicensable, nontransferable, non-assignable, revocable license for the term of this Agreement to access and use the Services. Services may only be used by Your Users for internal business purposes only. You agree to comply with the terms and conditions of this Agreement, including any Schedules, and with all applicable Company procedures and policies that further define use of the Services. You acknowledge and agree that the actions of any of Your Users with respect to the Services will be deemed to be actions by You and that any breach by any of Your Users of the terms of this Agreement, including any Schedule, will be deemed to be a breach by You.

  • Termination for Refusing Access to Public Records In accordance with section 287.058, F.S., the Department may unilaterally terminate the Term Contract for refusal by the Contractor to allow public access to all documents, papers, letters, or other material made or received by the Contractor in conjunction with the Term Contract, unless the records are exempt from s. 24(a) of Art. I of the State Constitution and section 119.071(1), F.S.

  • Specific Provisions for Access Rights to Software For the avoidance of doubt, the general provisions for Access Rights provided for in this Section 9 are applicable also to Software. Parties’ Access Rights to Software do not include any right to receive source code or object code ported to a certain hardware platform or any right to receive respective Software documentation in any particular form or detail, but only as available from the Party granting the Access Rights.
