Accumulation of Trainmen Seniority. A. In the event the Brotherhood of Locomotive Engineers and Trainmen invokes an “exclusive representation of Engineers” clause more restrictive than such in effect on the CPR/SOO-Line property as of June 1, 2015, and/or invokes seniority maintenance fees on the property for SMART-TD members holding engine seniority, then the following provisions will apply to train/yardmen who transfer or have transferred to engine service on this property: (1) Trainmen/yardmen who have transferred or transfer to engine service will not continue to accumulate train and yard service seniority unless they satisfy the following condition: A service fee payment to the SMART-Transportation Division will be required of such employees in order for them to continue accumulating train and yard service seniority. The Carrier will advise the SMART-TD in writing when train/yardmen transfer to engine service. (2) Trainmen/yardmen who fail to pay a service fee payment to the SMART- Transportation Division after transferring to engine service will not thereafter accumulate any additional train and yard service seniority, and thus will fall on any relevant trainmen's roster below employees who do continue to accumulate such seniority. B. It is recognized, the SMART-Transportation Division is the certified Collective Bargaining Representative for the craft of Conductors and Trainmen, and shall have the exclusive right to represent all Conductors and Trainmen in company level grievance, claim and disciplinary proceedings which are a result of this Rule. C. The service fee specified in the preceding paragraphs shall be based upon the costs of negotiating and engaging in all collective bargaining matters, but in no event shall exceed the amount of full monthly dues of the SMART-TD in effect on the SOO-Line property.
