The Performer agrees to require by written agreement with its employees, other than clerical and non-technical employees, to disclose promptly in writing to personnel identified as responsible for the administration of patent matters and in a format suggested by the Performer each subject invention made under this Agreement in order that the Performer can comply with the disclosure provisions of paragraph B of this Article. The Performer shall instruct employees, through employee agreements or other suitable educational programs, on the importance of reporting inventions in sufficient time to permit the filing of patent applications prior to U. S. or foreign statutory bars. 3. The Performer shall include, within the specification of any United States patent application and any patent issuing thereon covering a subject invention, the following statement: This invention was made with Government support under Agreement No. HR0011-XX-9-XXXX, awarded by DARPA. The Government has certain rights in the invention.

The Government has certain rights in the Invention.”
Action to Protect the Government’s Interest. Regeneron agrees to execute or to have executed and promptly deliver to the Government all instruments necessary to (i) establish or confirm the rights the Government has throughout the world in those Subject Inventions to which Regeneron elects to retain title, and (ii) convey title to the Government when requested under Subparagraph c of this Section 7.2 and to enable the Government to obtain patent protection throughout the world in that Subject Invention. i. Regeneron agrees to require, by written agreement, its employees, other than clerical and non-technical employees, to disclose promptly in writing to personnel identified as responsible for the administration of patent matters and in a format suggested by Regeneron, each Subject Invention made under this Agreement so Regeneron can comply with the disclosure provisions of this Section 7.2. Regeneron shall use reasonable efforts to instruct employees, through employee agreements or other suitable educational programs, on the importance of reporting inventions in sufficient time to permit the filing of patent applications prior to U.S. or foreign statutory bars. ii. Regeneron shall notify the Government of any decisions not to continue the prosecution of a patent application for a Subject Invention, pay maintenance fees, or defend in a reexamination or opposition proceedings on a patent of a Subject Invention, in any country, not less than thirty (30) calendar days before the expiration of the response period required by the relevant patent office. Regeneron shall include, within the specification of any United States patent application and any patent issuing thereon covering a Subject Invention, the following statement: “This invention was made with Government support under Agreement MCDC2020-504, awarded by the U.S. Department of Health and Human Services. The Government has certain rights in the invention.”

The Recipient agrees that the inventing Project Participant will execute or have executed and promptly deliver to Advanced Technology International all the instruments necessary to (i) establish or confirm the rights the Government has throughout the world in those subject inventions to which the Project Participant elects to retain title, and (ii) convey title to the Government when requested under paragraph D of this Article and to enable the Government to obtain patent protection throughout the world in that subject invention. 2. The Recipient agrees to require, by written agreement, that employees of its organization and the organizations of the Project Participants working on this project, other than clerical and nontechnical employees, agree to disclose promptly in writing, to personnel identified as responsible for the administration of patent matters and in a format acceptable to the Advanced Technology International, each subject invention made under this Agreement in order that the Project Participant can comply with the disclosure provisions of paragraph C of this Article and to execute all papers necessary to file the patent applications on the subject invention and to establish the Government’s rights in the subject invention. The Recipient shall instruct its employees and each Project Participant shall instruct its employees, through employee agreements or other suitable educational projects, on the importance of reporting inventions in sufficient time to permit the filing of patent applications prior to U.S. or foreign statutory bars. 3. The Recipient shall notify the Advanced Technology International of any Project Participant’s decision not to continue the prosecution of a patent application, pay maintenance fees, or defend in a reexamination or opposition proceedings on a patent, in any country, not less than thirty (30) calendar days before the expiration of the response period required by the relevant patent office. 4. The Project Participants shall include, within the specification of any United States patent application and any patent issuing thereon covering a subject invention, the following statement: “This invention was made with Government support under Agreement No. __________ awarded by the Advanced Technology International with the Naval Sea Systems Command (NAVSEA) funding. The Government has certain rights in the invention.”

The CONTRACTOR shall instruct employees, through employee contracts or other suitable educational programs, on the importance of reporting Inventions in sufficient time to permit the filing of patent applications prior to U.S. or foreign statutory bars. 3. The CONTRACTOR shall notify the Government Agreements Officer of any decisions not to continue the prosecution of a patent application, pay maintenance fees, or defend in a reexamination or opposition proceedings on a patent, in any country, not less than thirty (30) calendar days before the expiration of the response period required by the relevant patent office. 4. The CONTRACTOR shall include, within the specification of any United States patent application and any patent issuing thereon covering a Subject Invention, the following statement: “This Invention was made with Government support under Contract No. FA8811-15-9-0001, awarded by SMC/LR. The Government has certain rights in the Invention.”
Action to Protect the Government’s Interest. 6.1 Developer agrees to execute or to have executed and promptly deliver to In-Q-Tel for delivery to the CIA all instruments necessary: (1) to establish or confirm the Government's rights in those Subject Inventions to which Developer elects to retain title; and (2) to convey title to the Government when requested under Section 4 of this exhibit and to enable the Government to obtain patent protection in that Subject Invention.

The PAH acknowledges and shall instruct its employees, through employee agreements or other suitable educational programs, on the importance of reporting inventions in sufficient time to permit the filing of patent applications prior to U.S. or foreign statutory bars.

The Coordinating Center shall instruct employees, through employee agreements or other suitable educational programs, on the importance of reporting inventions in sufficient time to permit the filing of patent applications prior to U. S. or foreign statutory bars. 9.5.3 The Coordinating Center shall include, within the specification of any United States patent application and any patent issuing thereon covering a subject invention, the following statement: This invention was made with Government support under Agreement No. HT9425- XX-3-XXXX, awarded by USAMRDC. The Government has certain rights in the invention.
