Adherence to Terms. Should Vendor fail to strictly adhere to and follow the terms set by Sailfest NJ, then Vendor will be in default under this Agreement and Sailfest NJ may immediately terminate this Agreement upon notice to Vendor. In the event of a default by the Vendor, the Vendor will forfeit as liquidated damages the amount paid for participation, regardless of whether or not Sailfest NJ enters into another agreement for the space. Said damages are agreed to in no way constitute a penalty, but rather a reasonable estimate of Sailfest NJ damages which are incalculable with any degree of certainty. Sailfest NJ reserves the right to make changes to the terms of this Agreement at any time for any reason.

Adherence to Terms. The failure of a party to insist upon strict adherence to any term of this Grant Agreement shall not be considered a waiver or deprive the party of the right thereafter to insist upon strict adherence to that term, or any other term of the Grant Agreement.

  • Adherence to Law Each party shall comply with all federal, state and local laws and ordinances applicable to this agreement.

  • Adherence to Standards For purposes of clarity, consistency, and ease of understanding, the State, as an acquiring agency of private property for public use, has adopted standards and formats for right-of-way mapping which have proven to facilitate the processes of negotiation, appraisal, relocation assistance, and condemnation. The Engineer’s Surveyor shall adhere to these standards and formats to every extent possible to ensure that the needs of the State are met.
