Adjustability. The Loans principal amount owed by IBEROAMERICAN to the Creditors will be determined and paid in Pesos, at the Unidad de Fomento rate in force on the respective payment date thereof, provided that, if payment shall be made after the stated maturity, and on such date the Unidad de Fomento rate shall be higher, then, the latter rate shall be used. Pursuant to the provisions of paragraph nine of Section 35 of the Charter of Chilean Central Bank, contained in section one of Law 18,840, published on the Official Gazette of October 10, 1989, the parties hereto agree that, if for whichever reason, either the Unidad de Fomento, or its current calculation modality no longer existed, all obligations stated in Unidad de Fomento under this Agreement will continue to be governed by the rules therefore in force as at such date, unless the parties agree on replacing such rules for a new system for the adjustment of Chilean banks transactions, as issued by the Central Bank of Chile.
Adjustability. The need for adjustments must be avoided where possible. Where adjustment points cannot be avoided, they must be readily accessible, adequately identified, and self-locking to prevent inadvertent adjustment or drift.
Adjustability. B.1 All daily adjustments shall be easily made by the user from a seated position. Standard adjustments include: seat height; backrest height and angle; seat pan depth and angle; armrest height; and horizontal armrest distance. B.2 Seat pan and backrest shall adjust independently. Synchronized seat/back adjustment mechanisms are not acceptable.

Contractor is encouraged to incorporate environmentally preferable Products or Services into its work performance wherever possible. "Environmentally preferable" means Products or Services that have a lesser or reduced effect on human health and the environment when compared with competing products or services that serve the same purpose. This comparison may consider raw materials acquisition, production, manufacturing, packaging, distribution, reuse, operation, maintenance, or disposal of the Product or Service.

  • Stability Testing Patheon will conduct stability testing on the Products in accordance with the protocols set out in the Specifications for the separate fees and during the time periods set out in Schedule C. Patheon will not make any changes to these testing protocols without prior written approval from Client. If a confirmed stability test failure occurs, Patheon will notify Client within [***], after which Patheon and Client will jointly determine the proceedings and methods to be undertaken to investigate the cause of the failure, including which party will bear the cost of the investigation. Patheon will not be liable for these costs unless it has failed to perform the Manufacturing Services in accordance with the Specifications and cGMPs. Patheon will give Client all stability test data and results at Client’s request.

  • PROCEDURAL HISTORY On May 16, 2008, pursuant to 83 Illinois Administrative Code Part 763, Illinois Bell Telephone Company (“AT&T Illinois”) and Vertex Broadband, Corp. d/b/a AthenaTel d/b/a Reason to Switch d/b/a TownLink Communications d/b/a INT Connections (“Vertex”), filed a joint petition for approval of the Interconnection Agreement dated May 7, 2008 under Section 252 of the Telecommunications Act of 1996 (47 U.S.C. §§ 151 et seq.) (“the Act”). The Agreement was submitted with the petition. A statement in support of the petition was filed along with verifications sworn to by ▇▇▇▇▇ ▇. ▇▇▇▇, ▇▇. on behalf of AT&T Illinois and by ▇▇▇▇▇▇ ▇. ▇▇▇▇▇ on behalf of Vertex, stating that the facts contained in the petition are true and correct to the best of their knowledge, information, and belief. Pursuant to notice as required by law and the rules and regulations of the Commission, this matter came on for hearing by the duly authorized Administrative Law Judge of the Commission at its offices in Chicago, Illinois, on June 9, 2008. Staff filed the Verified Statement of A. ▇▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇ of the Commission’s Telecommunications Division on June 6, 2008.   • Traceability 11.1 Under the terms of this Agreement, Supplier shall have and operate a process to ensure that all Products, sub-assemblies and the components contained therein supplied to the Buyer are completely Traceable back to manufacturer by batch or lot or date code. 11.2 Further Supplier hereby agrees, unless directed otherwise by the Buyer, to procure components through franchised distributors or direct component Suppliers. Supplier agrees to indemnify and hold the Buyer harmless from and against all costs and expenses for the removal, repair or replacement and reinstallation of counterfeit components incorporated into a Product sold by Supplier to the Buyer where the counterfeit component was procured by Supplier from a person or entity other than a franchised distributor or direct component Supplier or other person or entity pre-approved by the Buyer in writing.

  • Compatibility 1. Any unresolved issue arising from a mutual agreement procedure case otherwise within the scope of the arbitration process provided for in this Article and Articles 25A to 25G shall not be submitted to arbitration if the issue falls within the scope of a case with respect to which an arbitration panel or similar body has previously been set up in accordance with a bilateral or multilateral convention that provides for mandatory binding arbitration of unresolved issues arising from a mutual agreement procedure case. 2. Nothing in this Article and Articles 25A to 25G shall affect the fulfilment of wider obligations with respect to the arbitration of unresolved issues arising in the context of a mutual agreement procedure resulting from other conventions to which the Contracting States are or will become parties.”.
