ADJUSTMENT OF PERFORMANCE STANDARDS. The parties shall review during the last quarter of every Contract Year and may adjust, as appropriate, the Performance Standards for the following Contract Year. In addition, either Streamline or Genco may, at any time upon notice to the other party, initiate discussions to review and, upon agreement by the parties, adjust any Performance Standard which such party in good faith believes is inappropriate at that time.
ADJUSTMENT OF PERFORMANCE STANDARDS. In the event that Acceptance (as defined in the EPC Contract) is achieved by payment of liquidated damages pursuant to Article 12 of the EPC Contract, Operator and Owner shall negotiate in good faith to adjust the performance standards set forth in this Article VIII to reflect the reduced performance capabilities of the Project. ADJUSTMENT OF PERFORMANCE STANDARDS. The Management Committee shall review during the last quarter of every Contract Year and may adjust, as appropriate, and as agreed upon by THC and PSC, the Performance Standards for the following Contract Year. In addition, either THC or PSC may, at any time upon notice to the other Party, initiate discussions to review and, upon agreement by the Management Committee, adjust any Performance Standard which such Party in good faith believes is inappropriate at that time.
ADJUSTMENT OF PERFORMANCE STANDARDS. The Executive Committee shall review during the last quarter of every calendar year and shall adjust and implement, as appropriate, the Performance Standards. In addition, either UHS or Unisys may, at any time upon notice to the other Party, request review and, upon agreement by the Executive Committee, adjust any Performance Standard which such Party in good faith believes is inappropriate at that time.

  • Monitoring of Performance Vendor shall continuously monitor and record its performance to ensure that all of Vendor's responsibilities and obligations hereunder are being met and fulfilled. Citizens may conduct programmatic and other administrative contract monitoring during the term of this Agreement. The purpose of this monitoring is to ensure that all of Vendor's responsibilities and obligations are being met and fulfilled. Such monitoring may include on-site visits, report reviews, invoice reviews, compliance reviews, and a review of any other areas reasonably necessary. Vendor acknowledges and agrees that Citizens may also monitor and record Vendor Staff communications to the extent they occur within or are connected to any Citizens’ resource, such as electronic or telecommunications systems.
