Admissibility of Disputes Resolution Proceedings Clause Samples

The "Admissibility of Disputes Resolution Proceedings" clause defines whether and how information, statements, or documents generated during dispute resolution processes—such as mediation or arbitration—can be used as evidence in subsequent legal proceedings. Typically, this clause restricts the use of confidential communications or settlement offers made during these proceedings from being introduced in court, except under specific circumstances like proving a settlement was reached. Its core function is to encourage open and honest dialogue during dispute resolution by assuring parties that their discussions will not be used against them later, thereby facilitating more effective and candid negotiations.
