Prior to Final Acceptance, and upon the request of Developer, any successor to Developer, or any potential lender, purchaser or tenant of the Development, or any portion thereof, the Town shall confirm by a written instrument within twenty (20) days after such request, that no default by Developer under this Agreement exists as of the date of such written instrument (or if a default exists a description of such default), and such other information relating to the status of this Agreement as may be reasonably requested by the requesting party and the requesting party shall be entitled to rely upon the accuracy of the statements by the Town made therein.
