Common use of Allowances Clause in Contracts

Allowances. 4.1.1.1. DB Contractor acknowledges and agrees that the Price includes all Allowances (if any). Any Allowances and the amounts therefor are described in Exhibit 9 to this DBA. DB Contractor’s markups for overhead and profit and all other expenses contemplated for stated Allowance items are included in the Allowance amount, unless otherwise specified in Exhibit 9. 4.1.1.2. Whenever costs are more or less than the applicable Allowance amount set forth in Exhibit 9, the Price shall be adjusted to reflect the difference between actual costs and the Allowance amount; provided, however, that DB Contractor shall not incur expenses on account of Allowance items in excess of the applicable Allowance amount without TxDOT’s prior written approval.
