Amendment 1. Section 3 of the Agreement, TERM OF AGREEMENT, is amended to read as follows:

Amendment 1. The definition of the term “VMware Separate Tax Liability” in Section 1 of the Agreement is hereby amended in its entirety to read as follows:

Amendment 1. The Expiration Date of the original Option Agreement #24, as defined in Section 1(b), is hereby amended to read February 19, 2021;

Amendment 1. Section 3.1 of the Mining Lease shall be amended as follows: 3.1 This Lease will have a Term beginning on the date of this Lease and ending on the expiration or earlier termination of the Option Agreement, except in the event that Optionee elects to exercise the option to purchase the Property in which event the term of the Mining Lease shall have a term ending on the closing date of the Option Agreement, and any subsequent amendments thereto.
