Amendment to Subsection Clause Samples
Amendment to Subsection. Subsection 8.5 of the Credit Agreement is hereby amended by (i) deleting the word "and" appearing at the end of clause (e) thereof, (ii) replacing the period at the end of clause (f) thereof with the phrase "; and" and (iii) adding at the end of such subsection the following new clause (g):
Amendment to Subsection. 8.1(c). Subsection 8.1 of the Credit Agreement is hereby amended by deleting paragraph (c) of such subsection in its entirety and substituting in lieu thereof the following new paragraph:
Amendment to Subsection. 2.3. Subsection 2.3 of the Credit Agreement is hereby amended by deleting such subsection in its entirety and substituting in lieu thereof the following:
Amendment to Subsection. 8.3. Subsection 8.3(j) of the Credit Agreement is hereby amended by deleting the text in its entirety and inserting in lieu thereof [Reserved].
Amendment to Subsection. 11.9. Subsection 11.9 of the Credit Agreement is hereby amended by adding the following new paragraph (m) after paragraph (l) thereof:
Amendment to Subsection. 1. Subsection 6.1 of the Credit Agreement is hereby amended by (a) deleting the amount "$250,000,000" in clause (b) thereof and substituting therefor the amount "$300,000,000" and (b) deleting the amount "$250,000,000" in clause (c) thereof and substituting therefor the amount "$300,000,000".
Amendment to Subsection. 5.1(d). The Agreement is amended by deleting current Section 5.1(d) in its entirety and replacing it with the following new Section 5.1(d):
(d) by the Investor, upon written notice to the Company, in the event that the conditions of Closing set forth in Section 1.2(c)(1) are not satisfied on or before October 29, 2010;
Amendment to Subsection. 8.3. Subsection 8.3 of the Credit and --------------------------- Guarantee Agreement is hereby amended by (a) deleting the word "and" at the end of the paragraph (n) thereof, (b) deleting the period at the end of paragraph (o) thereof and substituting in lieu thereof the following: "; and" and (c) adding thereto the following new paragraph (p):
Amendment to Subsection. 1.2(c). The Agreement is amended by deleting current Section 1.2(c)(1)(viii) in its entirety and replacing it with the following new Section 1.2(c)(1)(viii):
Amendment to Subsection. 10.1. Subsection 10.1 of the Credit Agreement is hereby amended by deleting clause (c) thereof in its entirety.
