Common use of Ancillary Development Clause in Contracts

Ancillary Development. In the event of the potential development of property adjacent to the Ballpark, subject to any implied or actual confidentiality agreements of either party, Landlord and Tenant agree to use commercially reasonable efforts to communicate with one another with respect to such development so that the interests of the Ballpark, as well as their mutual and individual interests, are taken into consideration when planning and carrying out such development. The parties acknowledge and agree that this Section 7.3 does not in any way commit the City in any manner with respect to such future development.
