Common use of Annual Leave Loading Clause in Contracts

Annual Leave Loading. (a) In addition to their Annual Leave payment, an employee will be paid the higher of: (i) an annual leave loading of 17.5% of their Annual Leave; or (ii) the weekend and shift penalties the employee would have received had they not been on leave during the relevant period. (b) The Annual Leave loadings in clause 22.6(a) are not payable for days which have been added to be taken in conjunction with annual leave in accordance with the election provisions of clause 20 - Public Holidays or for purchased additional leave in accordance with clause 22.9. (c) Shift allowances and weekend penalties are not payable for public holidays which occur during a period of annual leave.
