Common use of Anticorruption Measures Clause in Contracts

Anticorruption Measures. The Borrower shall: (a) undertake necessary measures to create and sustain a corruption-free environment; (b) ensure that its anticorruption laws and regulations and ADB’s Anticorruption Policy (1998) are strictly enforced and are being complied with during Project implementation, and that relevant provisions of ADB’s Anticorruption Policy (1998) are included in all bidding documents for the Project; (c) facilitate ADB’s exercise of its right to investigate, directly or through its agents, any alleged corrupt, fraudulent, collusive or coercive practices relating to the Project; (d) ensure that the Project Executing Agency conducts periodic inspections on the contractors’ activities related to fund withdrawals and settlements; and (e) ensure that all contracts financed by ADB in connection with the Project include provisions specifying the right of ADB to audit and examine the records and accounts of the Project Executing Agency and all contractors, suppliers, consultants and other service providers as they relate to the Project.

The Borrower shall: Recipient shall (ai) undertake necessary measures to create and sustain a corruption-free environment; (bii) ensure that its anticorruption laws and regulations and ADB’s 's Anticorruption Policy (1998) , as amended to date), are strictly enforced and are being complied with during Project implementation, and that relevant provisions of ADB’s 's Anticorruption Policy (1998) are included in all bidding documents for the Project; (ciii) facilitate in ADB’s 's exercise of its right to investigate, directly or through its agents, any alleged corrupt, fraudulent, collusive or coercive practices relating to the Project; (div) ensure that the Project Executing Agency MID conducts periodic inspections on of the contractors’ ' activities related to fund withdrawals and settlements; and (ev) ensure that all contracts financed by ADB in connection with the Project include provisions specifying the right of ADB to audit and examine the records and accounts of the Project Executing Agency MID and all contractors, suppliers, consultants and other service providers as they relate to the Project.
