Applicability of Competitive Procedures. The procedures for vacancies filled under competitive actions are described in this Article. Promotions - Any selection for promotion must be made on a competitive basis unless it is excluded by Section 5 below. Reassignments/Changes to Lower Grade - Any selection to a position that provides specialized experience (Job Qualification System for Trades and Labor Occupations, OPM Handbook X-118C or appropriate qualification standards) that the employee does not already have and is required for subsequent promotion to a designated higher-graded position and/or to a position with known promotion potential must be made on a competitive basis. Details - Competitive procedures will be applicable to any selection for detail of more than 60 calendar days to a higher-graded position, to a position with known promotion potential, or a position which provides specialized experience (Job Qualification System for Trades and Labor Occupations, OPM Handbook X-118C or appropriate qualification standards) required for subsequent promotion to a designated higher-graded position. All details will be consistent with Article 25 - Details, Reassignments and Temporary Promotions. Training - Competitive procedures will be applicable to selections for training when eligibility for promotion to a particular position depends on whether the employee has completed that training. Appointments - Competitive procedures apply to the transfer of a Federal employee or to the reinstatement of a former Federal employee to a position above the highest grade previously held permanently (unless the position is a higher-graded successor position as described in Section 5, Paragraph A7 of this Article) or to a position at or below that grade if the position has promotion potential above the highest grade previously held permanently. When competitive procedures apply to outside candidates the Department will utilize the procedures regarding area of consideration as outlined in Section 6D below.
Applicability of Competitive Procedures a. When a vacancy in the unit of recognition is filled by competitive procedures, it will be filled -from among the best qualified candidates. b. The following actions, not all inclusive, may be taken non-competitively, unless otherwise provided: (1 Promotion of the incumbent of a reclassified posi­ tion or of an individual having reemployment rights to that position will be taken non-competit�vely when: (a) the reclassification is the result of gradual accrual of duties and the individual has per­ formed these duties satisfactorily over a rea­ sonable period of time; or (b) the reclassification results from a change in the content, interpretation, or application•.«•�o.f.l,, classification standards.
Applicability of Competitive Procedures. A. Promotions Competitive selection procedures apply to any selection for promotion to positions unless it is specifically excluded by Section 14 (Non-Competitive Actions) of this Article. B. Reassignments Competitive procedures only apply to the following type of reassignment: any selection to a position at the same or lower grade with more promotion potential than that of any position previously held on a permanent basis in the Competitive Service (except as permitted by Reduction-in-Force regulations contained in 5 C.F.R.§ 351). C. Details Competitive procedures apply to the following details to a: 1. higher graded position; or 2. position with greater promotion potential greater than that of the employee’s current position of record; or 3. position in a series different than that currently occupied by the employee which: a. provides specialized experience as identified in the OPM Qualifications Handbook in the series/occupation that the employee is being detailed to, which the employee does not already have, and b. is required for subsequent promotion to a higher graded position. D. Formal Training or Career Development Program Competitive procedures apply to any selection to a formal training or career development program when eligibility for promotion to a particular position depends on whether the employee has completed that training. E. Reinstatements Competitive procedures apply to any reinstatement of a former Federal employee to: 1. a higher graded position than the candidate’s highest grade previously held on a permanent basis, or 2. a position with more promotion potential than the highest actual grade previously held on a permanent basis.

  • Impasse Procedures Impasse proceedings shall be in accordance with § 6-408 of the Education Article to the Annotated Code of Maryland.

  • New Procedures New procedures as to who shall provide certain of these services in Section 1 may be established in writing from time to time by agreement between the Fund and the Transfer Agent. The Transfer Agent may at times perform only a portion of these services and the Fund or its agent may perform these services on the Fund's behalf;

  • Purpose; Incorporation by Reference of Auction Procedures and Settlement Procedures (a) On each Auction Date, the provisions of the Auction Procedures will be followed by the Auction Agent for the purpose of determining the Applicable Rate for the of APS, for the next Dividend Period therefor. Each periodic operation of such procedures is hereinafter referred to as an "Auction."   • DISCIPLINE PROCEDURES The Employer agrees to provide the employee with written notification of a disciplinary document that is to be made a part of the employee’s personnel file. In instances where the Employer desires to conduct an investigatory interview with an employee, the employee shall be entitled upon request to have an Association representative present at the interview. A copy of all disciplinary actions involving suspension or discharge will also be provided to the Association, unless the employee requests that the matter be kept confidential.

  • Informal Procedures A. The grievant should first discuss the matter with his/her principal or administrator or supervisor to whom he/she is directly responsible in an effort to resolve the problem informally. B. If the grievant is not satisfied with the disposition of the matter, he/she shall have the right to have a representative of his/her choice to assist him/her in further efforts to resolve the problem informally with the principal or other appropriate administrator or supervisor.
