Common use of Application of Collective Agreement Clause in Contracts

Application of Collective Agreement. Except as otherwise provided, the terms and conditions of this Agreement shall apply to Employees engaged as Apprentices in accordance with the provisions of Article 2 (Application of Agreement). However, Article 12 (Grievance Procedure) and Article 31 (▇▇▇▇▇▇ and Recall) shall not apply in respect of the termination of employment as an Apprentice as a result of: (a) The discontinuance of an apprenticeship program, or (b) The failure of an apprentice to comply with the terms and conditions of the Industry Training and Apprenticeship Training Act and/or regulations, or (c) The unavailability of a Tradesman position upon completion of the apprenticeship program, or (d) The unavailability of work required at the next higher period of apprenticeship to which the Apprentice is eligible to advance.
