The Mining Company will require the technical, financial and administrative assistance of a legal entity designated by the majority shareholder and who will act in the capacity of Operator. For this purpose, RANDGOLD CI LTD being the majority shareholder, nominates MIJL as the Operator. Appointment of the Operator. Subject to and in accordance with the provisions of this Agreement, the Authority hereby appoints, on a non-exclusive and non-transferable basis, and the Operator hereby accepts its appointment to maintain 11 Sidhi Lawn and organise events there in accordance with the terms of this Agreement and subject to the applicable laws and clearances.
Appointment of the Operator. The Airports Company hereby appoints the Operator to provide the Services in return for payment of the Service Fees in accordance with the terms and conditions of this Agreement. The Operator hereby accepts such appointment. The Operator acknowledges that the Airports Company will be under no obligation to provide the Operator with a continuous flow of work or revenue. It is recorded that this Agreement is entered into on a principal-to-principal basis. Nothing in this Agreement, whether express or implied, shall be construed as creating any relationship either of landlord/tenant, employee/employer, principal/agent, partnership, associate or any other relationship of a like nature, between the Airports Company and the Operator or any of the Operator's employees, directors, officers or agents. Furthermore, the Operator shall not, under any circumstances: conclude any agreement in the name of the Airports Company or that would bind the Airports Company unless previously authorised to do so in writing; pledge the credit of the Airports Company or bind the Airports Company or act for and on behalf of the Airports Company in any way whatsoever; nor hold itself out as being employed by or in partnership with or associated with the Airports Company in any way other than as an independent contractor in terms of this Agreement. The Parties record that due to the nature of the Services, there are certain aspects of the Services where the Airports Company requires that it maintains a degree of control and/or supervision over the Operator's activities.

Appointment of the Operator. 2.1 The Trust, (a) relying on the Operator's Representations, (b) in consideration of the obligations and duties assumed by the Operator under the Project Documents, and (c) on and subject to the terms and conditions of the Project Documents, appoints the Operator exclusively (subject to the terms of the Project Documents) to undertake and complete the Works, to provide maintain, repair, renew and replace the Equipment, maintain, repair and renew the Facilities and to provide the Services throughout the Term (but in all cases subject to the lawful exercise of any termination rights set out or referred to in this Agreement).
2.2 The Operator (a) relying on the Trust's Representations, (b) in consideration of the obligations and duties assumed by the Trust under the Project Documents to which it is a party, and (c) on and subject to the terms and conditions of the Project Documents to which it is a party, accepts the appointment made under Clause 2.1.
Appointment of the Operator. Subject to and in accordance with the provisions of this Agreement, the Authority hereby appoints, on a non-exclusive and non-transferable basis, the Operator, and the Operator hereby accepts its appointment to Procure/Supply, Operate and Maintain 125 Nos of 12m BRT AC Electric Buses and Procure, Operate and Maintain Transformers and Chargers and Establish & Maintain associated Electrical and Civil Infrastructure. The Electric Buses shall be as per Technical Specifications given in Volume 3 of the RFP andthe Operator shall maintain Daily Assured Fleet Availability, within the Bus Service Area in accordance with the terms of this Agreement and subject to the Applicable Laws and Applicable Clearances.
Appointment of the Operator. 3.1 The Owner appoints the Operator to provide Letting Services for the Residence and the Operator accepts the appointment. The appointment of the Operator is exclusive.
3.2 The Owner hereby grants to the Operator the sole and exclusive right with all necessary authority to operate and manage the letting of the Residence to Tenants in accordance with the terms of this Agreement including such things as:
(a) terminating tenancies and/or visits of occupiers of the Residence for noisy, offensive or unlawful behaviour;
(b) inform others (including the police) of information necessary to eject and/or prosecute offensive guests, visitors and Tenants; and
(c) any other actions as is necessary to operate and manage the Residence.
3.3 The Owner will not during the Term of this Agreement let or agree to let the Residence nor grant any license or other rights in relation to the Residence to any other person for the provision of services similar to that of the Operator subject to the owner’s Occupancy Rights pursuant to clause 5.3.
3.4 Upon signing this Agreement, the Owner will provide to the Operator all keys (hard and magnetic keys), security tags, manuals for any of the Contents and any other items required for the use and security of the Residence in order for the Operator to manage the Residence pursuant to this Agreement.
