Assessing eligibility Clause Samples

The 'Assessing eligibility' clause defines the process and criteria by which a party determines whether an individual or entity qualifies for a particular benefit, service, or participation. Typically, this involves reviewing specific qualifications, documentation, or compliance with set standards before granting access or approval. For example, eligibility might be assessed based on age, residency, financial status, or completion of required forms. The core function of this clause is to ensure that only those who meet predetermined requirements are considered, thereby maintaining fairness and consistency in the application or selection process.
Assessing eligibility. The Training Provider must determine whether an individual is eligible to receive their Skills First Entitlement before their commencement in training. The Training Provider must have a clear and documented business process for determining if an individual is eligible for Skills First subsidised training. This process must include assessment of all the requirements in Clause 2 of this Schedule 1 and must comply with the Guidelines About Eligibility. In accordance with the Guidelines About Eligibility, the Training Provider must, for each Skills First Student: record its assessment of the individual’s eligibility using the form prescribed by the Department in those Guidelines, or in a form that records the same information; and sight and retain Evidence of Eligibility. If the Training Provider grants an eligibility exemption to an individual in accordance with a program or initiative in Part C of this Schedule 1, it must sight and retain any additional evidence that is specified in the Guidelines About Eligibility. If the Training Provider enrols an individual in a program that, as part of that program's accreditation, includes a requirement for them to provide evidence that they meet particular entry requirements, the Training Provider must sight and retain a copy of that evidence. For example, to enrol in 22567VIC Certificate I in Transition Education an individual must provide evidence of permanent cognitive impairment or intellectual disability.
