Assignments and Vacancies. A) When any certificated vacancy occurs within the District, the district agrees to solicit and utilize members of the Association (when available) in the interviewing process. Members chosen shall have input. B) To assure that students are taught by teachers working within their areas of competence and/or specialties, employees shall not be assigned, except in accordance with the regulations of the State Board of Education, to subjects, grade levels and/or areas outside their teaching certification without consultation. C) Employees shall be notified in writing no later than May 30 of any change in their teaching assignments for the ensuing school year. D) If, after May 30, any curricular or extra-curricular assignment change is made, notification of such change shall be given to the affected employee no later than thirty (30) calendar days prior to the effective date of change. If any emergency change not covered by the above is required, the affected employee will be promptly consulted; and if possible, the employee’s preference will be followed. E) To assure a quality program is offered, only qualified employees will be assigned to perform any supplemental stipend duties as they are cited in the extra-curricular schedule criteria form. F) To assure that certificated employees are given consideration in filling any positions which occur at any time within the District, the following procedures shall be used: 1) During the school year, certificated employees and the Association shall be given notice of all vacancies and new positions by posting a notice thereof in the faculty lounge sufficiently in advance to enable District employees to submit a letter of interest to be considered for such vacancy or new position. Current employees will be considered finalists for any job they apply for provided they meet the stated requirements for the position. Bargaining unit members who currently hold bargaining unit designated extra curricular positions shall have first choice to retain the current assignment. Class advisors shall have the option to follow their classes. Bargaining unit co-curricular positions shall be posted by May 1 and bargaining unit members shall have seven (7) working days thereafter to apply for such positions. 2) During the summer months, the District shall post a notice of all vacancies and new positions at the District Administrative Office. Said notice shall set forth the qualification for the position and the procedures for applying. A copy of any such notice shall be mailed to the PEA President.

B) To assure that students are taught by teachers working within their areas of competence and/or specialties, employees shall not be assigned, except in accordance with the regulations of the State Board of Education, to subjects, grade levels and/or areas outside their teaching certification without consultation.
C) Employees shall will be notified of their assignments for the following year in writing no later than May 30 by the last day of unit member attendance. It is understood by both parties that changes in enrollment and staffing may cause some modifications of those assignments and that a unit member will be notified as soon as practicable of any change in their teaching assignments for the ensuing school year.
D) Ifassignment. In the event of a transfer of assignment or location, after May 30, any curricular or extra-curricular assignment change is made, notification of such change due consideration shall be given to the unit member’s length of service to the District, qualifications and preference of the unit members affected employee and shall not be disciplinary. Past evaluations of the unit member will also be taken into consideration. Unit members requesting a building transfer to a vacant position within their current tenure area may do so by adhering to transfer request procedures by completing the appropriate form and submitting it to the designated administrator by no later than thirty (30) calendar days April 15. In the event the unit member is interested in transferring to a position currently encumbered by another unit member, then a meeting with the building principal or Superintendent may be requested by no later than April 15 in lieu of completing the aforementioned transfer request procedures. Those unit members requesting a transfer will not be required to participate in the regular instructional hiring procedures as they apply to applicants not already on staff. Although the final decision for transfer is not reviewable, the unit member transferred shall, upon request, be given the reasons for the transfer in writing and, if the unit member chooses, a meeting with the Superintendent to discuss the justification for the transfer prior to the effective date of changethe transfer. If any emergency change not covered Final assignment determination will be based upon what is determined to be in the best interest of the instructional program, as determined by the above is required, the affected employee will be promptly consulted; and if possible, the employee’s preference will be followedSuperintendent.
E4.1.2 Having been reviewed pursuant to Article 2, Section 2.4 [Study Groups) To assure a quality program is offeredthe assignment and obligations of shared and part-time teachers as agreed to are set forth as Appendix C.
4.1.3 Notice of appointment, only qualified employees will be assigned if made to perform any supplemental stipend duties co-curricular and interscholastic activities as they are cited listed in the extra-curricular schedule criteria form.
F) To assure that certificated employees are given consideration in filling any positions which occur at any time within the DistrictAgreement herein, the following procedures shall be used:
1) During the school year, certificated employees and the Association shall be given notice at least thirty (30) days prior to the start of all vacancies and new positions by posting a notice thereof in the faculty lounge sufficiently in advance to enable District employees to submit a letter of interest to be considered for such vacancy each activity or new position. Current employees will be considered finalists for season.
4.1.4 Whenever any job they apply for provided they meet the stated requirements for the position. Bargaining unit members who currently hold bargaining unit designated extra curricular positions shall have first choice to retain the current assignment. Bargaining unit teaching, co-curricular positions or interscholastic vacancy covered by this Agreement shall be posted by May 1 and bargaining unit members shall have seven (7) working days thereafter to apply for such positions.
2) During the summer monthsoccur, the District shall post a written notice of all vacancies same, containing a description of the qualifications for and new positions the duties of the position in the principals' offices and faculty rooms in each of its schools, and shall provide a copy of said notice to the Association. No such vacancy shall be filled, except on a temporary basis, until it shall have been so posted for at least ten (10) calendar days. This clause shall in no way operate as a limitation on the District Administrative Officeas to sources for filling such vacancies or new positions.
4.1.5 Whenever a bargaining unit, co-curricular, or interscholastic position is established by the District during the life of this Agreement, the terms and conditions of employment relative to said new position(s) will be negotiated with the Association. Said notice shall set forth This clause is not intended to be, or be interpreted as, a clause requiring the qualification for negotiation of a new position or creation of same by the position and negotiation process or the procedures for applying. A copy filling of any such notice shall be mailed to the PEA Presidentsaid positions.
