At-Sea Monitoring Clause Samples

The At-Sea Monitoring clause establishes requirements for the observation and recording of activities aboard vessels while at sea. Typically, this clause mandates the presence of independent monitors or the use of electronic monitoring systems to collect data on fishing practices, catch composition, or compliance with regulations. At-Sea Monitoring. If the trip is selected for coverage under the 6 ASM Program, Vessels shall follow all appropriate Sector ASM 7 Program protocols and processes as outlined in this section. 8 Sector Vessels selected for ASM coverage are not allowed to set 9 sail until the ASM arrives and is onboard or a waiver is granted 10 by the ASM Provider(s).
At-Sea Monitoring. If the trip is selected for coverage under the 22 ASM Program, Vessels shall follow all appropriate Sector ASM 23 Program protocols and processes as outlined in this section.
At-Sea Monitoring. 27 The SHS2 will participate in the Northeast Fisheries Observer Program (NEFOP) and the 28 NMFS and/or industry-funded at-sea monitoring (ASM) program while they operate. 29 This ASM coverage will have vessel and trip selection coordinated through NMFS and 30 will use approved at-sea providers and monitors. The Sector manager will maintain a 31 database of all catch data, including but not limited to VTR, dealer, monitor, and observer 32 data. NMFS will provide the Sector with data from NEFOP and the ASM program. 33 The SHS2 will contract one or more of the companies approved by NOAA Fisheries to 34 provide monitoring services and will notify NOAA Fisheries of its selection no later than 35 April 1, 2021.

The sector will transition to its approved industry- funded ASM program when NMFS funding for ASM ends, pursuant to an independent contract between the Sector and a NMFS approved provider. This ASM coverage will have vessel and trip selection coordinated through NMFS and will use approved at-sea monitors. The Sector manager will maintain a database of all catch data, including but not limited to VTR, dealer, monitor, and observer data. NMFS will provide the Sector with data from NEFOP and the ASM program.
At-Sea Monitoring. 19 The TSS does not plan to have any additional At Sea Monitoring coverage beyond that 20 provided by NMFS as part of the NEFOP.
At-Sea Monitoring. The Sustainable Harvest Sector will participate in the Northeast Fisheries Observer Program (NEFOP) and the NMFS-funded at-sea monitoring (ASM) program. Any additional ASM coverage beyond the NMFS-funded level will be provided pursuant to an independent contract between the Sector and a NMFS approved provider. This additional ASM coverage will have vessel and trip selection coordinated through NMFS, will be conducted in the same manner with the same protocols as the NMFS-funded ASM program, and will use approved at- sea monitors, unless otherwise instructed. Also, this additional coverage will not be allowed to replace or interfere with either the coverage of NEFOP or the NMFS-funded ASM program. The Sector manager will maintain a database of all catch data, including but not limited to VTR, dealer, monitor, and observer data. NMFS will provide the Sector with data from NEFOP and ASM program.

The SHS3 will deploy at-sea monitors in a way to achieve X% of trips that is random and representative of fishing activities of the sector. The SHS3 will use the NOAA Fisheries-designated ASM program. Failure to comply with ASM Program Requirements If the sector is informed of a potential violation of any regulations that govern the At-Sea Monitor priogram (including but not limited to: vessels failing to provide adequate notification prior to departing, failing to take an At-Sea Monitor, incidents of At-Sea Monitor interference, harassment, or intimidation), the sector manager will conduct an investigation of the alleged violation. The written investigative report will be provided to the owner of the applicable sector vessel and to the NMFS. If the sector's investigation finds a violation occurred, the manager will suggest corrective action to the member. If a violation (as determined by both the sector and an investigation by the NMFS Office of Law Enforcement) places the sector's ability to comply with requirements of the ASM program in jeopardy, the member will be subject to the penalties described under VIOLATIONS REGARDING ASM REQUIREMENTS in Section 5.15.
