AUDIT DISALLOWANCES Sample Clauses

The Audit Disallowances clause establishes the right of a party, typically a funding agency or auditor, to review and reject costs or expenses that are found to be unallowable under the terms of an agreement or applicable regulations. In practice, this means that if an audit reveals certain expenditures do not comply with contract requirements or governing rules, those costs can be disallowed and may need to be repaid or absorbed by the recipient. This clause serves to ensure accountability and proper use of funds by providing a mechanism to recover or deny reimbursement for inappropriate or unsupported expenses.
AUDIT DISALLOWANCES. If at any time, County determines that a cost for which payment has been made is a disallowed cost, such as overpayment, County shall notify the Contractor in writing of the disallowance. County shall also state the means of correction, which may be but shall not be limited to adjustment of any future claim submitted by the Contractor by the amount of the disallowance, or to require repayment of the disallowed amount by the Contractor.

AUDIT DISALLOWANCES. 17.1 The Subrecipient shall, upon written notice, reimburse the County for any payments made under this Agreement that are disallowed by a federal, state, or County audit in the amount of the disallowance. Court costs and attorney and expert fees incurred will be specifically identified as applicable to the recovery of the disallowed costs in question. 17.2 If the County determines that a cost for which payment has been made is a disallowed cost, then the County will notify the Subrecipient in writing of the disallowance and the required course of action, which shall be at the option of the County, either to adjust any future claim submitted by the Subrecipient by the amount of the disallowance or to require immediate repayment of the disallowed amount by the Subrecipient issuing a check payable to the County.
