Common use of Authorization and Appointment Clause in Contracts

Authorization and Appointment. Subject to Partner’s acceptance of and ongoing compliance with these Terms and any applicable PPA, Podium hereby authorizes and appoints Partner as a non-exclusive reseller and distributor of the Podium Products specified in Partner’s PPA. Although the terms “distribute,” “sell,” and “sale” may be used throughout this Agreement, the parties recognize and agree that the Podium Products are only licensed and/or sublicensed, not sold.
