Availability Notification. 5.2.1 No later than 5:00 a.m. (Pacific Time) of each day, Supplier shall deliver to Buyer an Availability Notice in the form set forth in Exhibit G. 5.2.2 Availability Notices shall provide, for the ninety-six (96) hour period starting at 6:00 a.m. (Pacific Time) that day, Supplier's hourly projection of the unavailability or derating ("Derating") of the Asset Bundle compared to the Asset Bundle Capacity figures stated for each unit in Exhibit A. Each Availability Notice also shall contain, as applicable: (a) the units which are subject to a Derating; (b) the magnitude of the Derating; (c) the hours during which the Derating is expected to apply; (d) the cause of the Derating; (e) the extent, if any, to which the Derating is attributable to a Permitted Derating; and (f) the projected Asset Bundle Capacity for each unit during the period covered by the Availability Notice, pursuant to Section 5.2.4 below. 5.2.3 If and to the extent a Derating is the result of one or more of the following causes, it shall be a Permitted Derating: (a) approved planned outages pursuant to Section 21; (b) response to an Emergency Condition as described in Section 20; or (c) subject to the limitations expressed in Section 12.5, a Force Majeure event. 5.2.4 In respect of any Dispatch Hour, the Asset Bundle Capacity of each unit shall be the Asset Bundle Capacity figure stated in Exhibit A minus any Permitted Derating applicable during such hour. 5.2.5 Neither the Asset Bundle Capacity nor the Supply Amount shall be reduced by Deratings which are not Permitted Deratings. Supplier shall be responsible for all Replacement Costs, pursuant to Section 4.2.1, caused by Deratings that are not Permitted Deratings.

Availability Notification. Unless otherwise specified, BellSouth will respond to an application within ten (10) calendar days (In Mississippi, ten (10) business days) as to whether space is available or not available within a BellSouth Remote Site Location. With the exception of Georgia, this interval excludes National Holidays. If the amount of space requested is not available, BellSouth will notify ALEC Inc., of the amount of space that is available and no Application Fee shall apply. When BellSouth’s response includes an amount of space less than that requested by ALEC Inc.,, ALEC Inc., must resubmit its Application to reflect the actual space available.

If the amount of space requested is not available, BellSouth will notify BTC of the amount that is available. 2.2.2 BellSouth will respond to a Louisiana Application within ten (10) calendar days for space availability for one (1) to ten (10) Applications; fifteen (15) calendar days for eleven (11) to twenty (20) Applications; and for more than twenty (20) Applications, it is increased by five (5) calendar days for every five additional Applications received within five (5) business days. If the amount of space requested is not available, BellSouth will notify BTC of the amount of space that is available. 2.2.3 BellSouth will respond to a Mississippi Application within ten (10) business days as to whether space is available or not available within a BellSouth Premises. If the amount of space requested is not available, BellSouth will notify BTC of the amount of space that is available.

Availability Notification. WMRE must notify City Light Real- Time Marketing (see Exhibit K, Contact Information) as soon as reasonably practicable when a Forced Outage, event of Force Majeure or a transmission curtailment of the Interconnection Facilities affecting the Facility and Facility Expansion occurs and when the Facility Expansion recovers from such contingency.

SMUD is responsible for notifying SCL when a Forced Outage, Uncontrollable Force or transmission curtailment on Puget’s transmission system affecting the Burlington Project occurs and when the Burlington Project recovers from such contingency. Notice is deemed given by SMUD if given by Owner or by Puget to SCL. SCL shall then issue an e-Tag adjustment request (if Puget has not already done so) within the time period defined in the NERC/NAESB timing tables. SCL shall not issue an adjustment request with a schedule change start date/time that is earlier than the adjustment request submittal date/time unless mutually agreed.

Availability Notification. Unless otherwise specified in this Agreement, BellSouth will respond to an Application within ten (10) calendar days as to whether space is available or not available within the requested Premises. This interval excludes National Holidays. If the amount of space requested is not available, BellSouth will notify Powertel of the amount of space that is available and no Application Fee will be billed. When BellSouth’s response includes an amount of space less than that requested by Powertel or differently configured, Powertel must resubmit its application as a new application, subject to an Application Fee, to reflect the actual space available prior to submitting a Bona Fide Firm Order.

Availability Notification. Unless otherwise specified, AT&T will respond to an application within ten (10) calendar days as to whether space is available or not available within an AT&T Premises. This interval excludes National Holidays. If the amount of space requested is not available, AT&T will notify SouthEast of the amount of space that is available.

Availability Notification. Seller shall, by noon each day, ------------------------- inform Buyer of the estimated Capacity (taking into account the effect of any expected deratings) that will be available to Buyer for the following three (3) days. These estimates shall not be binding upon Seller and Seller may subsequently alter its estimates. Seller shall advise Buyer of any changes in its estimated Capacity as soon as practicable.
