Common use of Availability of Data Clause in Contracts

Availability of Data. From time to time at the request of OSI, but not more than once in any Calendar Quarter and only during the year following the Effective Date, Serono shall make available to OSI, and Serono shall cause its Affiliates to make available to OSI, during regular business hours and on reasonable prior notice at Serono's facilities in Massachusetts, any information obtained by Serono pursuant to the License Agreement related to the Product in the Field that is relevant or appropriate to enable OSI to Promote and Detail and conduct MSL Activities and Clinical Trials, but only to the extent that such information has not already been supplied to OSI and that the provision of such information is not already otherwise contemplated in this Agreement.
