Common use of Availability Warranty Clause in Contracts

Availability Warranty. The Supplier shall not be liable for any defects in the System (hardware and/or Software) resulting from: (a) operating of the System by the Purchaser not in line with the Documentation provided the Documentation is correct, proper and complete, (b) changes, repairs or amendments to the System or any Part thereof not in compliance with this Contract provided that they have not been performed by the Supplier or its Affiliate or Sub Suppliers,
