Common use of Both parties recognize Clause in Contracts

Both parties recognize. (a) the principal of promotion within the service of the Employer; (b) In making appointments and filling vacancies the qualifications such as job knowledge, experience and education shall be the primary consideration, but where such qualifications are equal, seniority shall be the determining factor. The qualifications for the posted position or vacancy shall be consistent with the responsibilities specified in the posting including acceptable performance of the Employee’s current job. (c) As an alternative to (b), the Employer may elect at the time of posting to the following: When filling vacancies in a classification within the bargaining unit, seniority shall be the deciding factor.
