Budget overrun. In each Contract Year, if a Party determines that the budgeted cost for such Joint Global Study set out in the Joint Global Development Budget for which it is responsible is likely to be exceeded or is exceeded by more than [***] percent ([***]%), it shall: (i) promptly inform the Project Team of the expected or actual cost overrun; and (ii) provide the Project Team with a detailed, written explanation for the cost overrun for that activity, and complete and accurate records substantiating the expected or actual cost overrun. At its next regularly scheduled meeting, the CC shall determine by consensus as to whether, and to what extent, any cost overrun shall be absorbed by that Party, reimbursed by the other Party, or shared in some proportion between the Parties. If the CC determines that any aspect of the cost overrun should be reimbursed by the other Party, it shall prepare and approve an amended Joint Global Study Budget for that Contract Year accordingly. No reimbursement of any cost overrun shall be made if the Party seeking the reimbursement does not notify the other Party and first obtain approval in advance of such cost overrun as set forth above. If the reason for the expenses exceeding the approved budget by more than [***]% is attributable to the breach of this Collaboration Agreement, then the costs incurred that are more than the CC approved budget and not in accordance with this Section 5.3, the overrun expenses should be paid by the breaching Party. For avoidance of doubt, any Global Study conducted by A▇▇▇▇▇▇▇ or Allist that are not part of the Joint Development Plan, Allist or ArriVent can opt-in to the study but will need to reimburse the Party that conducted the study with [***]% external costs (e.g., CRO, investigator costs, etc.)

Budget overrun. In carrying out the approved work program and budget in a year, the Technical Services Provider may exceed individual budget items under the operation budget and the project investment budget up to 10%. However, no budget may be exceeded without the approval of the Operator by more than five per cent (5%) for each Joint Venture during a year. This article shall be reviewed if a unitisation of ownership interests in the gas transportation systems on the Norwegian continental shelf (“Gasled II”) is established. The Technical Services Provider may incur expenses not included in the above-mentioned operating budgets, provided such expenses are relevant to the performance of the Services, and do not exceed a total aggregate of two per cent (2.0%) of the operating budget in any year for each Joint Venture individually.
Budget overrun. To the extent that the actual costs of producing the Picture (including script rights acquisition, legal fees, setup of production offices, casting; location scouting) exceed the Production Budget ("Budget Overrun"), (i) the Members shall make the following additional capital contributions to the Company: (A) GrayMark Productions, Inc. shall make additional contributions equal to 50% of the first $50,000 of Budget Overrun; (B) A&A Productions, LLC shall make capital contributions equal to 25% of the first $50,000 Budget Overrun; and (C) Frozen Television, Inc. shall make capital contributions equal to 25% of the first $50,000 Budget Overrun. (ii) GrayMark Productions, Inc. shall make additional capital contributions equal to 100% of Budget Overruns in excess of $50,000.

  • Cost Overruns The Borrower shall ensure that all cost-overruns over the estimated construction costs of the Project as certified by a quantity surveyor or the Architect or as ascertained by the Lender as and when they occur shall be funded by the Borrower’s own equity;

  • Project Cost Overruns In the event that the Recipient determines that the moneys granted pursuant to Section II hereof, together with the Local Subdivision Contribution, are insufficient to pay in full the costs of the Project, the Recipient may make a request for supplemental assistance to its District Committee. The Recipient must demonstrate that such funding is necessary for the completion of the Project and the cost overrun was the result of circumstances beyond the Recipient's control, that it could not have been avoided with the exercise of due care, and that such circumstances could not have been anticipated at the time of the Recipient's initial application. Should the District Committee approve such request the action shall be recorded in the District Committee's official meeting minutes and provided to the OPWC Director for the execution of an amendment to this Agreement.

  • Budget 1. The Grantee budget for grant activities for the 2023 Summer Program and State fiscal year 2024 is $ 1,000,267. Any funds received under this grant will not be used to supplant funds normally budgeted for programs or service of the same or similar type. 2. The Grantee may transfer funds among its administrative budget line items as required to carry out the purposes of the grant. Transfer of funds within specified budget categories do not require approval from OSHE (i.e. moving funds from one counselor position to pay for another), however, any transfer of funds from one category to another will require prior approval from OSHE and will be treated as a modification to the program’s contract Attachment. 3. Any request for a budget modification must be in writing and must include a revised budget. All budget revisions and modifications must be in accordance with the EOF Regulations, Section N.J.A.C. 9A:11-6.11. The Grantee will be liable for all unapproved debts.

  • Project Budget A Project Budget shall be prepared and maintained by Grantee. The Project Budget shall detail all costs for which the Grant will be used during the Term. The Project Budget must be approved in writing by the Project Monitor. Grantee shall carry out the Project and shall incur costs and make disbursements of funds provided hereunder by the Sponsor only in conformity with the Project Budget. The current approved Project Budget is contained in Attachment “C”. Said Project Budget may be revised from time to time, but no Project Budget or revision thereof shall be effective unless and until the same is approved in writing by Project Monitor. The funds granted under this Grant Contract cannot be used to supplant (replace) other existing funds.

  • Construction Budget The total amount of funds indicated by the District for the entire Project plus all other costs, including design, construction, administration, and financing.
