Building Height. (a) The building heights proposed as part of any subsequent Development Application for the detailed design of the building must not exceed the heights expressed as RLs (AHD) shown on the drawings listed in the ‘Approved Developmentcondition of this consent. (b) This condition does not restrict development comprising building height: (i) proposed or erected by or on behalf of a public authority on land identified in the Voluntary Planning Agreement for transfer (and/or dedication) for the purpose of public amenities such as street furniture, street lighting, landscape structures or the like; (ii) located in the communal open space area for the purpose of landscape structures and communal facilities that do not comprise gross floor area and do not compromise deep soil provision.
Building Height. The maximum height of the building shall be as set forth on the Project Plans. In the event that any inconsistencies exist between the Zoning Ordinance and the building height allowed by this Agreement, then the building height allowed by this Agreement shall prevail.
Building Height. (a) The height of the buildings must not exceed: (i) Group 1 – 24.4 metres (ii) Group 2 – 24.95 metres (b) Prior to an Occupation Certificate being issued, a Registered Surveyor must provide certification that the height of the building accords with (a) above, to the satisfaction of the Principal Certifier.

Building Height. Residential Height is limited to a number of habitable floors (i.e., stories) exclusive of the area below the Ground Floor Level. One-half story is a habitable floor which has square footage that is no greater than one-half the square footage of the largest story. Buildings shall not exceed the number of stories and Height specified in Exhibits 13.2 and 13.3. Furthermore, except as noted below, no portion of a residential building (excluding fireplaces, chimneys and vents) may be taller than 30 feet from Ground Floor Level within 15 feet of any property line, nor taller than 35 feet from Ground Floor Level within 20 feet of any property line, except for the Freshfields Parcels. These setbacks do not apply to internal property lines in condominium or townhouse development. The Town may grant exceptions to these setbacks for interior property lines as identified through the platting process, provided that such exceptions do not adversely impact existing Development.
Building Height. The maximum building height including all roof top plant and equipment must not exceed 12m to ▇▇▇▇▇▇▇ Street and 22m to ▇’▇▇▇▇▇▇▇ Street and Geddes Avenue as defined in Sydney LEP 2012.
Building Height. Building heights will range between one and three stories and up to fifty five feet in height, except in Parcels A and C3, where building heights up to five stories may be considered through the PUD waiver process pursuant to Sec. 17.28.110 of the LMC and the guidelines set forth in the City’s 2013 Comprehensive Plan policy for Rural Special Districts, including a requirement for clustering of buildings. More specifically: (a) Structures shall be deemed clustered on Parcel A of the Amended GDP if: (1) through the PUD review process the City Council determines, following recommendation of the Planning Commission, that the building placement and site design on Parcel A achieves clustering consistent with the intent of the Comprehensive Plan; and (2) prior to or simultaneously with the recording of the first PUD on Parcel A that includes buildings which exceed the maximum building heights set forth in the LMC or adopted design standards, a Common Open Space deed restriction is recorded against the Common Open Space areas identified on Parcel A on the Amended GDP. (b) Structures shall be deemed clustered on Parcel C of the Amended GDP if: (1) through the PUD review process the City Council determines, following recommendation of the Planning Commission, that the building placement and site design on Parcel C achieves clustering consistent with the intent of the Comprehensive Plan; and (2) prior to or simultaneously with the recording of the first PUD on Parcel C that includes buildings which exceed the maximum building heights set forth in the LMC or adopted design standards a Common Open Space deed restriction is recorded against the Common Open Space areas identified on Parcels B and C on the Amended GDP. (c) Common Open Space shall be available for the use and enjoyment of the owner of such Common Open Space and its authorized visitors. Common Open Space shall be maintained primarily with native and natural vegetation but may contain limited improvements to enhance the use and functionality of the Common Open Space, such as utility easements/corridors, detention and water quality ponds, signage, trails, ponds, benches, storm water improvements, limited landscaping ...
