Common use of Building Over Clause in Contracts

Building Over. The Developer shall not build plant or place anything over or within three metres measured horizontally from the centreline of any Sewer (or such other distance as may be reasonably specified by ▇▇▇ ▇▇▇▇▇▇▇▇▇▇) without the written consent of ▇▇▇ ▇▇▇▇▇▇▇▇▇▇ PROVIDED THAT consent shall be deemed to be refused if consent is not given within ten days PROVIDED ALSO THAT this condition shall not apply to anything shown on the Drawings or the Layout Plan within the Protected Strip.

Building Over. The Developer shall not build plant or place anything over or within three [ ] metres measured horizontally from the centreline of any Sewer or Lateral Drain which are to be included in the Vesting Declaration (or such other distance as may be reasonably specified by ▇▇▇ ▇▇▇▇▇▇▇▇▇▇) without the written consent of ▇▇▇ ▇▇▇▇▇▇▇▇▇▇ PROVIDED THAT consent shall be deemed to be refused if consent is not given within ten days PROVIDED ALSO THAT this condition shall not apply to anything shown on the Drawings or the Layout Plan within the Protected Strip.

S.6 The Developer shall not build plant or place anything over or within three 2.5 metres measured horizontally from the centreline of any Sewer or Lateral Drain which are to be included in the Vesting Declaration (or such other distance as may be reasonably specified by ▇▇▇ ▇▇▇▇▇▇▇▇▇▇) without the written consent of ▇▇▇ ▇▇▇▇▇▇▇▇▇▇ PROVIDED THAT consent shall be deemed to be refused if consent is not given within ten 10 days PROVIDED ALSO THAT this condition shall not apply to anything shown on the Drawings or the Layout Plan within the Protected StripStrip .

Building Over. 6.1 The Developer shall not build plant or place anything over or within three 3 metres measured horizontally from the centreline of any Sewer sewer (or such other distance as may be reasonably specified by ▇▇▇ ▇▇▇▇▇▇▇▇▇▇the Authority) without the prior written consent of ▇▇▇ ▇▇▇▇▇▇▇▇▇▇ PROVIDED THAT consent the Authority 6.2 Consent under paragraph 6.1 shall be deemed to be refused if consent it is not given within ten days PROVIDED ALSO THAT this condition shall 10 days 6.3 Paragraph 6.1 does not apply to anything shown on the Drawings or the Layout Plan within the Protected Strip.
