BUS TRAVEL, CONDITIONS OF. (a) ARTISTS required to travel, rehearse and/or perform more than ten (10) hours in one (1) day shall be compensated at the travel overtime rate in half-hour segments. ARTISTS required to rehearse or perform after the 8th hour of required service on a travel day shall be compensated at the overtime rate. Travel will be counted from baggage call to arrival location, such time to include lunch stops and rest stops. Baggage call may be prior to 8:00 AM without penalty. The EMPLOYER will not be responsible for payment of the overtime travel penalty contained in this paragraph if the excess travel time was due to inclement weather, mechanical failure, or traffic accidents. A domestic or international travel overtime waiver will not be unreasonably denied. (b) Between arrival and the next scheduled rehearsal there shall be a full three (3) hour rest period, however, in the last ninety (90) minutes class may take place. If the EMPLOYER shall violate the provisions in this paragraph, the EMPLOYER agrees to compensate each ARTIST at the hourly penalty rate for each hour or fraction thereof for each such violation. When traveling from the city of origination, the ninety (90) minutes shall not apply when the distance traveled is seventy-five (75) miles or less, or if the time traveled is one and one-half (1-1/2) hours or less.
BUS TRAVEL, CONDITIONS OF. (a) Any Artist who is required to travel by bus more than six (6) hours per day shall be compensated for such travel at one half (1/2) of the hourly Overtime Rate for each half hour (1/2) of travel or fraction thereof.

BUS TRAVEL, CONDITIONS OF. 1. In any Monday through Sunday week, travel by bus shall not exceed a total of nine (9) hours excluding any in-city travel. Artists shall be paid at the overtime rate in half-hour increments for bus travel time over two (2) hours on a one-performance day, six (6) hours on a non-performance day, and for all bus travel on a two-performance day. Bus travel time shall be measured from pull-away to when the Artist receives a room key, and not counting breaks during travel. 2. There shall be an uninterrupted two (2) hour rest period after a bus trip during which time the Artist may not be called upon by the Employer to participate in any rehearsal for the Employer. If the Employer shall violate the provisions in this paragraph, the Employer agrees to compensate each Artist at the hourly Penalty Rate for each hour or fraction thereof for each such violation. The two hours shall not apply when the distance traveled is seventy-five (75) miles or less, or if the time traveled is one and one-half (1-1/2) hours or less.

ARTISTS required to render services or perform after the eighth (8th) hour of required service on a travel day shallbe compensated at the Overtime Rate. Travel will be counted from baggage call to arrival location, such time to include lunch stops and rest stops. Baggage call may be prior to 7:00 A.M. without overtime. The ATLANTA BALLET will not be responsible for payment of the overtime contained in this Paragraph if the excess travel time was due to inclement weather, mechanical failure or traffic accidents. b. Between arrival and the next scheduled rehearsal there shall be a full three (3) hour rest period; however, in the last sixty (60) minutes class may take place. If The ATLANTA BALLET shall violate the provisions in this paragraph, The ATLANTA BALLET agrees tocompensate each ARTIST at the hourly Overtime Rate for each hour or fraction thereof for each such violation. When traveling from the City of Origination, the three (3) hour rest period shall not apply when the distance traveled is twenty (20) miles or less from ▇▇▇▇ ▇▇▇▇ ▇▇▇▇▇▇▇▇▇, ▇▇▇▇▇▇▇, ▇▇▇▇▇▇▇, or if the time traveled is one and one-half (1-1/2) hours or less.

  • Additional Conditions to Obligations of Company The obligation of Company to consummate and effect the Merger shall be subject to the satisfaction at or prior to the Closing Date of each of the following conditions, any of which may be waived, in writing, exclusively by Company:

  • EXPRESS CONDITIONS A. The Employee will not receive compensation until they begin contracted service for the Board. B. Regardless of any board policy or term of this contract, the Board may, with two (2) weeks’ notice, lay-off or furlough the Employee with or without benefits and/or salary should the Board determine, in its sole discretion that exigent economic circumstances exist or that such a lay- off or furlough is in the best interests of the College. The Employee may be laid-off or furloughed to part-time status. If the Employee is laid off or furloughed to part-time status, the Employee will be paid salary pro rata, based on the Employee’s full-time salary. For Employees laid-off or furloughed to part-time status, the Board will determine whether benefits will be granted on a pro rata basis or continued in full for the duration of the lay-off or furlough. C. The Employee’s employment may be terminated with cause, or whenever in the discretion and judgment of the President or designee, if the Employee has failed to meet the performance expectations or productivity goals set by the College, including, but not limited to, income generating goals.

  • General Conditions (i) Each party will make each payment or delivery specified in each Confirmation to be made by it, subject to the other provisions of this Agreement. (ii) Payments under this Agreement will be made on the due date for value on that date in the place of the account specified in the relevant Confirmation or otherwise pursuant to this Agreement, in freely transferable funds and in the manner customary for payments in the required currency. Where settlement is by delivery (that is, other than by payment), such delivery will be made for receipt on the due date in the manner customary for the relevant obligation unless otherwise specified in the relevant Confirmation or elsewhere in this Agreement. (iii) Each obligation of each party under Section 2(a)(i) is subject to (1) the condition precedent that no Event of Default or Potential Event of Default with respect to the other party has occurred and is continuing, (2) the condition precedent that no Early Termination Date in respect of the relevant Transaction has occurred or been effectively designated and (3) each other applicable condition precedent specified in this Agreement.

  • Geographic Area and Sector Specific Allowances, Conditions and Exceptions The following allowances and conditions shall apply where relevant. Where the Employer does work which falls under the following headings, the Employer agrees to pay and observe the relevant respective conditions and/or exceptions set out below in each case.
