Common use of Caged Clause in Contracts

Caged. At DSLi’s expense, DSLi may arrange with a Supplier certified by BellSouth (“Certified Supplier”) to construct a collocation arrangement enclosure in accordance with BellSouth’s guidelines and specifications prior to starting equipment installation. BellSouth will provide guidelines and specifications upon request. Where local building codes require enclosure specifications more stringent than BellSouth’s standard enclosure specification, DSLi and DSLi’s Certified Supplier must comply with the more stringent local building code requirements. DSLi’s Certified Supplier shall be responsible for filing and receiving any and all necessary permits and/or licenses for such construction. BellSouth shall cooperate with DSLi and provide, at DSLi’s expense, the documentation, including existing building architectural drawings, enclosure drawings, and specifications required and necessary for DSLi to obtain the zoning, permits and/or other licenses. DSLi’s Certified Supplier shall ▇▇▇▇ DSLi directly for all work performed for DSLi pursuant to this Attachment and BellSouth shall have no liability for nor responsibility to pay such charges imposed by the DSLi’s Certified Supplier. DSLi must provide the local BellSouth building contact with two Access Keys used to enter the locked enclosure. Except in case of emergency, BellSouth will not access DSLi’s locked enclosure prior to notifying DSLi. Upon request, BellSouth shall construct the enclosure for DSLi. 3.2.1 BellSouth may elect to review DSLi’s plans and specifications prior to allowing construction to start to ensure compliance with BellSouth’s guidelines and specifications. Notification to DSLi indicating BellSouth’s desire to execute this review will be provided in BellSouth’s response to the Initial Application, if DSLi has indicated their desire to construct their own enclosure. If DSLi’s Initial Application Version 3Q01: 10/22/01 does not indicate their desire to construct their own enclosure, but their subsequent firm order does indicate their desire to construct their own enclosure, then notification to review will be given within ten (10) calendar days after the Firm Order date. . BellSouth shall complete its review within fifteen (15) calendar days after the receipt of the plans and specifications. Regardless of whether or not BellSouth elects to review DSLi’s plans and specifications, BellSouth reserves the right to inspect the enclosure after construction to make sure it is constructed according to the submitted plans and specifications and/or BellSouth’s guidelines and specifications, as applicable. BellSouth shall require DSLi to remove or correct within seven (7) calendar days at DSLi’s expense any structure that does not meet these plans and specifications or, where applicable, BellSouth guidelines and specifications.

Caged. BellSouth will make caged collocation available in fifty (50) square foot increments, which should be sufficient enough, to collocate a single rack/bay of equipment. DSLi NOS Communications, Inc. must provide the local BellSouth Central Office building contact with two Access Keys used to enter that will allow entry into the locked enclosure. Except in the case of an emergency, BellSouth will not access DSLiNOS Communications, Inc.’s locked enclosure prior to notifying DSLiNOS Communications, Inc. at least forty-eight (48) hours or two (2) business days, whichever is greater, before access to the Collocation Space is required. Upon request, BellSouth shall construct the enclosure for DSLi.NOS Communications, Inc.. 3.2.1 BellSouth may elect to review DSLiNOS Communications, Inc.’s plans and specifications prior to allowing construction to start start, to ensure compliance with BellSouth’s guidelines and specificationsSpecifications. Notification to DSLi indicating BellSouth’s BellSouth will notify NOS Communications, Inc. of its desire to execute this review will be provided in BellSouth’s response to the Initial Application, if DSLi NOS Communications, Inc. has indicated their its desire to construct their its own enclosure. BellSouth shall cooperate with DSLi GulfPines and provide, at DSLi’s GulfPines’ expense, the documentation, including existing building architectural drawings, enclosure drawings, and specifications Specifications required and necessary for DSLi GulfPines’ BellSouth Certified Supplier to obtain the zoning, all necessary permits and/or other licenses. DSLi’s GulfPines’ BellSouth Certified Supplier shall ▇▇▇▇ DSLi GulfPines directly for all work performed for DSLi pursuant GulfPines to comply with this Attachment and Attachment. BellSouth shall have no liability for for, nor responsibility to pay pay, such charges imposed by the DSLi’s GulfPines’ BellSouth Certified Supplier. Except in the case of an emergency, BellSouth will not access DSLi’s GulfPines’ locked enclosure prior to notifying DSLiGulfPines at least forty-eight (48) hours or two (2) business days, whichever is greater, before access to the Collocation Space is required. Upon request, BellSouth shall construct the enclosure for DSLiGulfPines. 3.2.1 BellSouth may elect to review DSLi’s GulfPines’ plans and specifications prior to allowing construction to start start, to ensure compliance with BellSouth’s guidelines and specificationsSpecifications. BellSouth shall require DSLi ALCALL to remove or correct within seven (7) calendar days at DSLiALCALL’s expense any structure that does not meet these plans and specifications or, where applicable, BellSouth guidelines and specificationsBellSouth’s Specifications.

Caged. At DSLiT-Mobile’s expense, DSLi T-Mobile may arrange with a Supplier certified by BellSouth (“Certified Supplier”) to construct a collocation arrangement enclosure in accordance with BellSouth’s guidelines and specifications prior to starting equipment installation. BellSouth will provide guidelines and specifications upon request. Where local building codes require enclosure specifications more stringent than BellSouth’s standard enclosure specification, DSLi T-Mobile and DSLiT-Mobile’s BellSouth Certified Supplier must comply with the more stringent local building code requirements. DSLiT-Mobile’s BellSouth Certified Supplier shall be responsible for filing and receiving any and all necessary permits and/or licenses for such construction. BellSouth shall cooperate with DSLi T-Mobile and provide, at DSLiT-Mobile’s expense, the documentation, including existing building architectural drawings, enclosure drawings, and specifications required and necessary for DSLi T-Mobile to obtain the zoning, permits and/or other licenses. DSLiT-Mobile’s BellSouth Certified Supplier shall ▇▇▇▇ DSLi bill T-Mobile directly for all work performed for DSLi T-Mobile pursuant to this Attachment Agreement and BellSouth shall have no liability for nor responsibility to pay such charges imposed by the DSLiT-Mobile’s BellSouth Certified Supplier. DSLi T-Mobile must provide the local BellSouth building contact with two Access Keys used to enter the locked enclosure. Except in case of emergency, BellSouth will not access DSLiT-Mobile’s locked enclosure prior to notifying DSLiT-Mobile. Upon request, BellSouth shall construct the enclosure for DSLi.T-Mobile 3.2.1 BellSouth may elect to review DSLiT-Mobile’s plans and specifications prior to allowing construction to start to ensure compliance with BellSouth’s guidelines and specifications. Notification to DSLi T-Mobile indicating BellSouth’s desire to execute this review will be provided in BellSouth’s response to the Initial Application, if DSLi T- Mobile has indicated their its desire to construct their its own enclosure. If DSLiT-Mobile’s Initial Application Version 3Q01: 10/22/01 does not indicate their its desire to construct their its own enclosure, but their its subsequent firm order does indicate their its desire to construct their its own enclosure, then notification to review will be given within ten (10) calendar days after the Firm Order date. . BellSouth shall complete its review within fifteen (15) calendar days after the receipt of the plans and specifications. Regardless of whether or not BellSouth elects to review DSLiT-Mobile’s plans and specifications, BellSouth reserves the right to inspect the enclosure after construction to make sure it is constructed according to the submitted plans and specifications and/or BellSouth’s guidelines and specifications, as applicable.
