Common use of Cancellation of Use Clause in Contracts

Cancellation of Use. Council reserves the right to suspend or cancel the Seasonal Club’s use of the Sports Ground and Pavilion, or transfer the allocation to another site, during times when: • The grounds are unsuitable for play • The Pavilion is in an unsuitable condition for use • Increasing damage and deterioration to the playing surface could result from excessive usage • Programmed capital works or maintenance needs to be undertaken. The Seasonal Club acknowledges that no part of the Seasonal Fee will be refunded where use of the Sports Ground or Pavilion is suspended or cancelled in accordance with the terms of this clause.
