Canine Assignment. The City shall pay Canine Officers an additional 11.31% of base salary for the on-duty responsibility of being a canine officer. The parties agree, to the extent permitted by law, this compensation is special compensation and shall be reported as such pursuant to Title 2 CCR, Section 571(a)(2) Canine Officer Premium. The Canine Officers shall also receive pay at the rate of $15.00 per hour paid at time and one half (1.5) for seven hours per pay period for all off duty hours spent caring, grooming, feeding and otherwise maintaining their canine. The City and officers understand and agree that this additional compensation is intended to compensate canine officers for all off duty hours spent caring, grooming, feeding and otherwise maintaining their canine, in compliance with the FLSA and interpretive cases and rulings. The parties acknowledge that the FLSA, which governs the entitlement to compensation for canine duties, entitles the parties to agree to a reasonable number of hours per month for the performance of off duty canine duties. The hours derived at in this agreement were determined after an actual inquiry of the officers assigned in the canine special assignment as addressed by ▇▇▇▇▇▇ v. City of ▇▇▇▇▇▇ City, 360 F.3d 1014 (9th Cir. 2004). It is the intent of the parties through the provisions of this section to fully comply with the requirements of the FLSA. In addition, both parties believe that this section of the MOU does comply with the requirements of the FLSA.
