CERTIFICATED EMPLOYEE EVALUATIONS. 6.1 The District retains responsibility for the evaluation and assessment of performance of each unit member, subject only to the following procedural requirements. Accordingly, no grievance arising under this Article shall challenge the content of the evaluation, nor shall it contest the judgment of the evaluator. Any grievances shall be limited to a claim that the following procedures have been violated. 6.2 It is agreed and understood that the provisions of this Article apply only to procedures for formal written periodic performance evaluations. District management reserves the right to observe employees in the performance of their duties, and to comment either in writing or orally. 6.3 Evaluation Procedures (a) Every probationary certificated employee shall be evaluated by the administration in writing at least once each school year. (b) Every permanent certificated employee shall be evaluated by the administration in writing at least every other year, or A Certificated employee and his/her evaluator may mutually agree that the employee will be evaluated only once every five (5) years if: ⮚ The certificated employee has permanent status ⮚ Has been employed by the school District for at least ten (10) years ⮚ Meets the Federal definition of highly qualified ⮚ Previous evaluations show that the employee has had an evaluation score of 39 points or higher. If either party wants to change the agreement, either may withdraw consent at any time. (c) No later than the end of the second school week of the year in which evaluation is to take place, the evaluator shall notify all employees who are to be evaluated. Prior to the commencement of the formal evaluation process, the evaluator and the certificated employee shall meet and discuss the elements upon which evaluation is to be based. A pre-evaluation form must be filled out by the employee to be evaluated. These elements shall be constrained by anomalies such as class size, intellectual abilities of the learners, availability of support personnel, the learning environment provided, and other pertinent factors; should there be an area of disagreement by the employee on an element of the evaluation, he/she shall have the right to file a written statement to that effect, which will be attached and filed with the employee's evaluation. (d) During the course of the evaluation period, mitigating circumstances may arise which require modification of the evaluation parameters. These will be determined by mutual agreement of the evaluator and the evaluatee. (e) Each formal evaluation of employees shall include three (3) formal observations. (f) If three (3) formal evaluations are not able to be completed due to circumstances beyond the control of employee or employer, an average of the completed observation scores will be used for the final score.
