Common use of Certificates of Occupancy and Certificates of Completion Clause in Contracts

Certificates of Occupancy and Certificates of Completion. (a) Upon Completion of Construction of the Project or any Phase of the Project, the Redeveloper shall diligently apply to the appropriate City construction code official for a Certificate of Occupancy. (b) Following Completion of the Project or any Phase of the Project and receipt of a Completion Notice from Redeveloper, the City agrees to issue a Certificate of Completion. The Certificate of Completion shall constitute a recordable, conclusive determination of the satisfaction and termination of the covenants and restrictions with respect to the Project, in this Redevelopment Agreement and the Redevelopment Plan. Within thirty (30) days after receipt of the Completion Notice, the City shall provide Redeveloper with the Certificate of Completion or a written statement setting forth in detail the reasons why it believes that Redeveloper has failed to Complete the Project, in accordance with the provisions of this Agreement or is otherwise in default hereunder. Upon issuance and recordation of the Certificate of Completion, the Declaration of Covenants and Restrictions for the Project shall be released to the extent set forth in the Declaration.
