Common use of Certification of the Settlement Class Clause in Contracts

Certification of the Settlement Class. For purposes of settlement and the proceedings contemplated by this Agreement only, subject to Court approval, the Parties stipulate and agree that a Settlement Class as defined in Paragraph 1.31 of this Agreement shall be provisionally certified pursuant to Federal Rule of Civil Procedure 23, that the Named Plaintiffs shall be the Class Representatives and shall represent the Settlement Class for Settlement Purposes, and that Class Counsel shall be appointed to represent the Settlement Class.

Certification of the Settlement Class. For 3.1.1. Solely for the purposes of settlement Settlement and the proceedings contemplated by this Agreement only, subject to Court approvalherein for effectuating the Settlement, the Parties stipulate and agree that a Settlement Class as defined in Paragraph 1.31 of this Agreement shall be provisionally certified pursuant to Federal Rule of Civil Procedure 23, that the Named Plaintiffs shall be the Class Representatives and shall represent Court may (i) certify the Settlement Class for Settlement Purposes, and that Class Counsel shall be appointed to represent in accordance with the Settlement Class.definition contained in Section 1.33 of this Agreement;

For purposes the purpose of implementing the settlement provided for under the terms of this Agreement, and the proceedings contemplated by this Agreement for that purpose only, subject Plaintiffs and Defendant agree to ask the Court approval, to certify the Parties stipulate and agree that a Settlement Class as defined in Paragraph 1.31 of this Agreement shall be provisionally certified pursuant to under the Federal Rule of Civil Procedure 23, that the Named Plaintiffs shall be the Class Representatives and shall represent the Settlement Class for Settlement Purposes, and that Class Counsel shall be appointed to represent the Settlement Class.

Neither this Settlement nor this paragraph nor any court order entered pursuant to this Settlement, that including but not limited to the Named Plaintiffs shall Preliminary Approval Order and the Final Approval Order, may be the Class Representatives cited as authority or precedent by either Party and shall represent the Settlement Class not stand as support of a motion for Settlement Purposes, and that Class Counsel shall be appointed to represent the Settlement Classcertification in any other case where certification is contested.
