Challenges to Calculation of Workweeks. Each Class Member shall have until the Response Deadline (plus an additional 14 days for Class Members whose Class Notice is re-mailed) to challenge the number of Workweeks and PAGA Pay Periods (if any) allocated to the Class Member in the Class Notice by sending the Administrator, by email or mail, a written Workweeks challenge, which must include the Class Member’s full name, signature, address, email address or telephone number, and last four digits of Social Security number for verification purposes. The Administrator must encourage the challenging Class Member to submit supporting documentation. In the absence of any contrary documentation, the Administrator is entitled to presume that the Workweeks contained in the Class Notice are correct so long as they are consistent with the Class Data. The Administrator’s determination of each Class Member’s allocation of Workweeks and/or PAGA Pay Periods shall be final and not appealable or otherwise susceptible to challenge. The Administrator shall promptly provide copies of all challenges to calculation of Workweeks and/or PAGA Pay Periods to Defense Counsel and Class Counsel and the Administrator’s determination the challenges.

Each Settlement Class Member shall have until sixty (60) days after the Response Deadline Administrator mails the Class Notice (plus an additional 14 fourteen (14) days for Settlement Class Members whose Class Notice is re-re- mailed) to challenge the number of Class Workweeks and PAGA Pay Periods (if any) allocated to the Settlement Class Member in the Class Notice Notice. The Settlement Class Member may challenge the allocation by sending communicating with the AdministratorAdministrator via fax, by email or mail, a written Workweeks challenge, which must include mail substantially in the Class Member’s full name, signature, address, email address or telephone number, and last four digits of Social Security number for verification purposes. form attached to this Agreement as Exhibit B. The Administrator must encourage the challenging Settlement Class Member to submit supporting documentation. In the absence of any contrary documentation, the Administrator is entitled to presume that the Workweeks contained in the Class Notice are correct so long as they are consistent with the Class Data. The Administrator’s determination of each Settlement Class Member’s allocation of Workweeks and/or and PAGA Pay Periods shall be final and not appealable or otherwise susceptible to challenge. The Administrator shall promptly provide copies of all challenges to calculation of Workweeks and/or PAGA Pay Periods to Defense Counsel and Class Counsel and the Administrator’s determination the challenges.
