The "Changes in Warning Regulations or Statutes" clause defines how a contract will address modifications to laws or regulations that govern product warnings during the term of the agreement. Changes in Warning Regulations or Statutes. In the event that the Office of Environmental Health Hazard Assessment or another authorized agency promulgates one or more regulations requiring or permitting warning text and/or methods of transmission different than those set forth above, or legislation is enacted by the California legislature, United States Congress or voters with such requirements or permission, ▇▇▇▇▇▇▇ ▇▇▇▇▇ shall be entitled to use, at its discretion, such other warning text and/or method of transmission without being deemed in breach of this Agreement. If regulations, legislation or judicial rulings are enacted or issued providing that a Proposition 65 warning for the product is no longer required, a lack of warning will not thereafter be a breach of this Agreement.

In the event that the Office of Environmental Health Hazard Assessment promulgates one or more regulations requiring or permitting Proposition 65 warning text and/or methods of transmission applicable to the Covered Products and the chemical at issue, which are different than those set forth above, ISDIN shall be entitled to use, at its discretion, such other warning text and/or method of transmission without being deemed in breach of this Agreement. If regulations or legislation are enacted providing that Proposition 65 warnings as to DEA in this product are no longer required, a lack of warning by ISDIN will not thereafter be a breach of this Agreement.

LKK shall instruct any third-party website to which it sells its Covered Products to include the same warning as a condition of selling the Covered Products.

If regulations or legislation are enacted providing that Proposition 65 warnings as to Cadmium in this product are no longer required, a lack of warning by Mars Food will not thereafter be a breach of this Agreement.

If regulations or legislation are enacted that modify the current safe harbor regulations, Euroasia is and will be considered in compliance with Proposition 65 if the warning meets the provisions of this Agreement. Moreover, if regulations or legislation are enacted providing that a Proposition 65 warning for the Product is no longer required, a lack of warning by Euroasia will not thereafter be a breach of this Agreement.

Vitauthority shall instruct any third-party website to which it sells its Covered Products to include the same warning as a condition of selling the Covered Products.

Likewise, the Noticed Party shall amend the warning to comply with the regulation if additional requirements or changes are promulgated by OEHHA.

Sunwarrior shall instruct any third-party website to which it sells its Covered Products to include the same warning as a condition of selling the Covered Products.

If regulations or legislation are enacted that modify the current safe harbor regulations, DC is and will be considered in compliance with Proposition 65 if the warning meets the provisions of this Agreement. Moreover, if regulations or legislation are enacted providing that a Proposition 65 warning is no longer required, a lack of warning by DC will not thereafter be a breach of this Agreement.
