Class Member Clause Samples
The "Class Member" clause defines who is considered a member of a class in the context of class action litigation. It typically specifies the criteria or characteristics that individuals must meet to be included in the class, such as being affected by a particular event or having a certain relationship to the subject matter of the lawsuit. For example, it may include all customers who purchased a specific product during a defined time period. This clause is essential for clearly identifying the scope of the class, ensuring that only eligible individuals are included, and preventing disputes over class membership.
Class Member. Each person eligible to participate in this Settlement who is a member of the Class as defined above.
Class Member. “Class member” means a member of one of the Classes, including named Plaintiffs.
Class Member. All current and former African American DUSMs who were subjected to USMS policies and practices consistent with the Class Claim referenced in Section II K., regarding promotions under the Merit Promotion Process, Management Directed Reassignments, and Headquarter Division assignments, and all African American current and former DUSMs, Detention Enforcement Officers, and applicants never employed who were subjected to USMS policies and practices consistent with the Class Claim referenced in Section II K., for hiring and recruitment of DUSM positions from January 23, 1994 to the date on which the Notice of Resolution is sent to Class Members (hereinafter, “Date of Notice of Resolution”). This definition is inclusive of Class Agents.
Class Member any person who is a participant in or applicant to the Adult Developmental Disability Services program (“DDS program”) administered by the Idaho Department of Health and Welfare as part of the Idaho Medicaid program, and who undergoes the annual eligibility determination or reevaluation process, is a class member.
Class Member. Each person eligible to participate in this Settlement who is a member of the Class as defined above, or, if such person is incompetent or deceased, the person’s legal guardian, executor, heir or successor in interest.
Class Member. Each person who is a member of the Class.
Class Member. “Class Member” means any member of the Class who does not timely opt out of the Settlement under Paragraph 8. If a Class Member has died, then the person’s estate, heirs, representatives, successors, or assigns is deemed a Class Member.
Class Member. Individual who is a member of either The Class and/or the Settlement Class.
Class Member. A borrower with a residential mortgage loan serviced by M&T from whom M&T collected a Pay-to-Pay Fee during the Class Period.
