Class Size - Limitation. Early childhood classes shall be limited to twenty (20) students with a teacher assistant for a ratio of one (1) adult to ten (10) students. Class Sizes: Grades Students Pre-K- Kindergarten 20 1st 21 2nd-3rd 23 4th-6th 25 For Pre-K through Sixth (6th) grade, if necessary, the District may increase up to two (2) students per class. Seventh through Twelfth (7th-12th) grade class sizes shall close at thirty (30) students per class. Administration will strive to balance class sizes among same subject areas. Subjects which are exempt from class size limitations by state law will be exempt from these class size limitations.

Each student above maximum shall remain in the classroom, and the teacher shall be compensated at the rate of $500.00 for each student on a prorated basis; or each student above maximum shall be removed from the classroom. At the K-8 level, the following standards shall be observed: K-1 (26 maximum); 2-3 (26 maximum); 4-6 (29 maximum). Split classes--two (2) fewer. Teachers of elementary split classes which do not exceed the maximum shall receive $1,000 as compensation. Teachers of split classes which exceed these maximums shall be compensated at the rate of five percent (5%) of the beginning BA base salary. Teachers will not be required to take split classes in consecutive years. These standards shall be in effect by the student count date.* On or before the student count date, the building administrator shall choose one of the following options if a class exceeds these maximums:

  • Damage Limitation IN NO EVENT SHALL THE COMPANY BE LIABLE TO THE SUBSCRIBER FOR ANY LOST PROFITS OR SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING SHALL BE INTERPRETED AND HAVE EFFECT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RULE OR REGULATION.

  • Reallocation to a Class with a Lower Salary Range Maximum 1. If the employee meets the skills and abilities requirements of the position and chooses to remain in the reallocated position, the employee retains the existing appointment status and has the right to be placed on the Employer’s internal layoff list for the classification occupied prior to the reallocation. 2. If the employee chooses to vacate the position or does not meet the skills and abilities requirements of the position, the layoff procedure specified in Article 31 of this Agreement applies.
