Common use of CMS Approval Clause in Contracts

CMS Approval. This Agreement requires approval by the Centers for Medicare & Medicaid Services (CMS). The Parties agree that during the pendency of such approval, neither Party is obligated to perform under this Agreement, and any expenses, costs, or liabilities incurred because of execution, or reliance thereon, of the Agreement will be at the incurring Party's sole risk.
