COMPENSABLE DELAY. For purposes of this Agreement, compensable delays (“Compensable Delay”) shall include only the following events and only if they impact the critical path of the Specific Project: (1) material neglectful act or omission by Exelon; and (2) material change ordered in the Work not due to Contractor’s fault.
