Common use of COMPENSABLE DELAY Clause in Contracts

COMPENSABLE DELAY. Delays in the Work caused by the wrongful act or neglect of the Owner or Separate Contractors, by a force majeure event in § 7.5, or by a change or suspension ordered in the Work shall entitle the Design/Builder to an adjustment of the Contract Time and/or Contract Sum by Change Order, provided that the Design/Builder has complied with the Contract Documents and submitted a change request. 5.3.1 The Owner shall not be responsible for costs that could have been avoided by reasonable means, including backcharging responsible parties, prudent scheduling of the Work, supplementation of labor or equipment, judicious use of overtime or proper administration of Consultants and Subcontractors.
