Common use of COMPENSABLE DELAY Clause in Contracts

COMPENSABLE DELAY. If Contractor is entitled to an increase in the Phase 2 Sum as a result of a Compensable Delay, determined pursuant to Articles 7 and 8 of the General Conditions, the Phase 2 Sum will be increased by the sum of XXXXX per day for each day for which such compensation is payable (“Compensable Delay Daily Rate”).This Article 7 will only apply if the County exercises its option for Phase 2, and only to the extent that Contractor fulfills requisites proving entitlement to Compensable Delay damages.
