The Compensation Upon Separation clause defines the payments and benefits an employee is entitled to receive when their employment ends. Typically, this clause outlines severance pay, accrued but unused vacation, and any other owed compensation, specifying the timing and method of payment. Compensation Upon Separation. Upon separation from the City's service an employee shall be entitled to compensation for earned but unused vacation leave to the employee's credit at the time of separation. Computation of pay for unused vacation shall be based on the hourly rate (as shown in the pay plan) times accrued but unused vacation hours. Death, either on duty or off duty, is considered as a separation from service, and compensation for accrued and unused vacation hours as identified in this Article will be paid according to law.

A. An employee retiring from City service will be credited for up to 175 days (1,400 hours) of accumulated but unused sick leave.
B. An employee separated for other reasons and otherwise eligible for compensation for sick leave upon separation will be credited for up to 160 days (1,280 hours) of accumulated but unused sick leave. These limitations apply to the computation of separation pay and percent credit as defined in this Section.
C. Separation pay is equal to the employee’s hourly rate of pay times the number of hours of compensable accumulated sick leave times a percentage credit. The percent credit will be calculated with the following formula with a minimum credit of 5%. The maximum credit would be 48.75%.
D. In case of death of an employee, severance pay for accrued sick leave shall be paid to the employee’s estate or beneficiaries.
E. The above provisions shall apply only to full-time employees who have completed one full year of service with the City of Xenia. An employee with less than ten (10) years of service is not eligible for severance pay for accumulated sick leave if the employee is dismissed from employment for unlawful or criminal conduct or resigns in anticipation of being dismissed for unlawful or criminal conduct. An employee with ten (10) years or more service shall be entitled to compensation for accumulated sick leave at his termination of employment, irrespective of cause, in accordance with the provisions of this Section.
Compensation Upon Separation. Employees must work a minimum of five (5) continuous years of service for the District to be eligible for any accrued sick leave compensation upon separation. This compensation is available only to employees that are separating employment for other than cause. Upon separation without cause or by retirement or any other voluntary reason, or a layoff, an employee has two options for reimbursement for accrued sick leave:
1. The employee may elect to be paid at a rate of fifty percent (50%) of the employee's total maximum accrued sick leave, not to exceed sixty-five (65) days [520 hours]. Such reimbursement shall be at the employee's salary rate at the time of separation, and shall reduce the employee's total amount of accrued sick leave to zero (0).
2. If retiring, the employee may elect to transfer their entire sick leave balance, one hundred percent (100%), to their CalPERS retirement account under the provisions of the sick leave credit contract provisions if applicable for the CalPERS formula Level the employee is classified in.
